A 1959 planned community with three different agencies working its roads
A crash in Carrollwood is a Hillsborough County claim under the same Florida law as anywhere else: fourteen days to get initial care, the injury threshold, two years to sue. What is local is the confusion about who is handling it. Carrollwood is unincorporated — 34,352 people at the 2020 census with no city government of their own — so the Hillsborough County Sheriff’s Office works most of its crashes. But Dale Mabry Highway down the middle is a state road the Florida Highway Patrol works, and the City of Tampa line is immediately east. Three agencies, three places to request a report, on roads that look identical. What follows is about that.
01 What a crash here actually looks like
A subdivision grid feeding one highway
Carrollwood was planned in 1959 and built out through the 1960s, laid out by Matt Jetton and developed by Sun State Homes, with more than 900 houses going up around Lake Carroll between 1959 and 1970. It expanded westward in the 1970s and 1980s into what became Carrollwood Village, and the census counts both together.
That layout matters more than it sounds. A planned community from 1959 is a community of curving residential streets with few exits, and nearly all of them empty onto the same handful of arterials. The crashes are concentrated where a 1960s subdivision street meets a highway built for through traffic.
Dale Mabry Highway is the spine, six lanes of it, carrying commuters between northern Hillsborough and the city. It is one of the road types where Tampa’s Vision Zero program finds 40% of its killed and severely injured pedestrians and cyclists.
The pedestrian deaths reported on this stretch of Dale Mabry share one shape: someone crossing mid-block rather than at a signal, a driver who stayed at the scene, and no criminal charges filed. That combination is where comparative fault decides the case, and it is the reason a claim here is worth more or nothing at all depending on evidence gathered in the first week.

02 What nobody tells you
The hospital on the highway is not where a serious injury ends up
Carrollwood has no police department, because it has no city. The Hillsborough County Sheriff’s Office patrols it — the county has exactly three incorporated cities, Tampa, Temple Terrace and Plant City, and everything else is the Sheriff’s. On Dale Mabry the Florida Highway Patrol may work the crash instead, and a few blocks east the Tampa Police Department takes over.
AdventHealth Carrollwood sits right on the highway, at 7171 North Dale Mabry Highway. It is a hospital with an emergency department, and it is not a trauma center. A serious injury from a Carrollwood crash is stabilized and moved: St. Joseph’s on Dr. Martin Luther King Jr. Boulevard is the Level II adult and state-designated pediatric trauma center, and Tampa General is the only Level I adult trauma center in Hillsborough County.
Two facilities means two sets of records and two bills. A $10,000 Personal Injury Protection limit does not survive an ambulance, an emergency department and a transfer, which is why the question of what other coverage exists comes up on the first call rather than months later.
The housing stock is the oldest part of the story. A community whose homes went up between 1959 and the early 1970s is a community of original cast-iron drains, re-roofed roofs and wiring installed under codes that no longer exist. When a pipe or a roof fails, the insurer’s argument is the age of the house rather than the event, and that argument is won with documents.
A Carrollwood case is filed in the Thirteenth Judicial Circuit, at 800 East Twiggs Street downtown. Most injury claims are resolved with the insurer before any lawsuit is filed.
03 The roads
Where the claims actually come from
North Dale Mabry Highway, six lanes through the middle of the community, past the hospital, the shopping centers and every subdivision entrance on both sides of it.
Busch Boulevard, the southern approach, moving east-west traffic between Dale Mabry and the city at arterial speed.
Bearss Avenue, the northern crossing, two lanes in places and carrying far more traffic than two lanes were drawn for.
Fletcher Avenue, the other east-west route, connecting the community to the university district and the interstate.
The subdivision entrances themselves, where a curving residential street with limited sight distance meets a highway, and where the left turn across six lanes is the single most common way a Carrollwood claim begins.
04 What to do now
The things that can only be done in the first two weeks
A checklist, not advice about your own situation. Nothing here requires hiring anyone.
Get seen within fourteen days
Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. The emergency department on Dale Mabry counts for this; so does urgent care, and so does your own doctor.
Write down which agency responded
Sheriff, Highway Patrol or Tampa Police. In Carrollwood it is genuinely unpredictable, and the agency determines nothing about your rights but everything about where the report lives. Note the agency and the report number.
Ask where you were taken, and where you were taken next
If you were transferred out of AdventHealth Carrollwood to a trauma center, there are two charts and two bills. Both belong in the file, and the transfer itself is evidence of severity.
Photograph the sight line at the entrance
The pattern here is a left turn out of a subdivision across six lanes. What the driver could actually see — past a hedge, a wall, a parked car, a sign — is the whole argument, and hedges get trimmed within the month.
Pull your own declarations page
Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.
Do not give the other insurer a recorded statement
You are not required to. The answer given in the first week gets quoted back for the next two years.
05 The kinds of crash this covers
One highway, four different claims
Hillsborough County recorded 26,269 traffic crashes in 2024, with 17,359 people injured and 180 killed, according to the Florida Department of Highway Safety and Motor Vehicles. No published count exists for Carrollwood alone. What a community of 34,352 people with a six-lane highway through the middle of it produces is the local part.
Car accidents
The bulk of it, and here it is the turn rather than the open road: a vehicle crossing or entering six lanes from a residential street, judging a gap in traffic that was moving faster than it looked.
Pedestrian accidents
Crossing Dale Mabry on foot means crossing six lanes with signals far apart. The reported deaths here were mid-block crossings with no charges filed, which is exactly the case that turns on § 768.81 — more than half the fault and the claim recovers nothing.
Motorcycle accidents
A six-lane arterial with a commercial driveway every few hundred feet is where a motorcycle meets a car turning left across it. There is no Personal Injury Protection requirement for a motorcycle, so what coverage exists is the first question rather than the last.
Uninsured drivers
A commuter highway carries drivers from everywhere else in the county, which means the person who hits you here frequently carries the state minimum — and Florida’s minimum includes no bodily injury liability at all. The claim then moves to your own policy, and your declarations page becomes the most important document in the file.
06 Also for Carrollwood
The other matters this office takes from here
Injury work is most of this practice. The rest run from the Tampa office south on Dale Mabry, each with its own page and its own fee terms.
Property insurance claims
The claim this community generates more than any other. Houses built between 1959 and the early 1970s reach the age where roofs, supply lines and panels fail, and the insurer’s first move is to call the failure wear rather than a covered loss. Notice of the claim is due within one year of the date of loss.
Family law
Divorce, time-sharing, support, property and protective orders in the Thirteenth Judicial Circuit, filed downtown at 800 East Twiggs Street.
Criminal defense
Bond and release conditions, DUI, drug charges, theft and domestic violence. In unincorporated Carrollwood the arrest is the Sheriff’s rather than Tampa Police, and the first appearance is still downtown.
Immigration
Removal defense, bond, asylum, family petitions and citizenship. None of Florida’s three immigration courts is in Tampa, so what controls a case is not where you live.
07 How this works
The consultation, the documents, and what it costs
The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.
The Tampa office is at 4231 N Habana Avenue, south of here off the same highway. It is the office that serves all of Hillsborough County.
Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

Jose A. Dapena
Admitted to The Florida Bar in 1998, number 152358, and admitted to the United States District Courts for the Southern, Middle and Northern Districts of Florida — the Middle District covers Hillsborough.
Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf: the same analysis a claim meets now, learned from the other side of the file.
09 The law behind this

80% of medical expenses and 60% of lost wages up to $10,000, and the fourteen-day deadline for initial care.
- Fla. Stat. § 768.81 Comparative fault
More than 50% at fault and the claim recovers nothing, which is the whole argument in a mid-block crossing.
- Fla. Stat. § 627.70132 Property claim notice
Notice of a new or reopened property claim within one year of the date of loss, counted from the loss itself.
- Fla. Stat. § 95.11 Deadlines
Two years to sue on most negligence claims accruing on or after March 24, 2023.

Questions
Who writes the crash report in Carrollwood?
Usually the Hillsborough County Sheriff’s Office, because Carrollwood is unincorporated and has no police department of its own. On Dale Mabry Highway the Florida Highway Patrol may work it instead, and a few blocks east the area becomes the City of Tampa and the report belongs to Tampa Police. Whichever agency wrote it, the report is requested through the FLHSMV crash portal.
Which hospital would I be taken to?
AdventHealth Carrollwood at 7171 North Dale Mabry Highway is the nearest emergency department, but it is not a trauma center. A serious injury is stabilized there and transferred — to St. Joseph’s, the Level II adult and state-designated pediatric trauma center on Dr. Martin Luther King Jr. Boulevard, or to Tampa General, the county’s only Level I adult trauma center.
I was transferred to a second hospital. Does that complicate the claim?
It adds paperwork rather than difficulty. There are two charts and two sets of bills, and both belong in the file. The transfer itself is useful evidence, because a hospital does not move a patient to a trauma center over a minor injury. It also guarantees that the $10,000 Personal Injury Protection limit will not cover the medical side, which is why other coverage gets identified early.
Is there an office in Carrollwood?
No. The office is at 4231 N Habana Avenue, south of here off the same highway, and it serves all of Hillsborough County.
My claim is about my house, not a crash.
That is the most common non-injury matter from this community. A house built between 1959 and the early 1970s has usually been re-roofed at least once and still carries some of its original supply lines and drains, so the dispute is almost never about whether there is damage. It is about whether the failure was a sudden loss or something that had been happening quietly for years — and the second answer is not covered. What settles it is documentation of the failure and of whatever was repaired before it. Notice has to reach the insurer within one year of the date of loss, counted from the loss itself.
Where would my case be heard?
In the Thirteenth Judicial Circuit, at the Hillsborough County Courthouse, 800 East Twiggs Street. Most injury claims are resolved without a lawsuit.
How long do I have?
Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims. A property insurance claim runs on its own clock: notice within one year of the date of loss.
