Homestead car accident lawyer

In downtown Homestead, minutes from the courthouse that hears these cases

A crash in Homestead, Florida City or the Redland is a Miami-Dade County claim, but almost nothing else about it matches a crash downtown. The case is usually heard at the South Dade Justice Center rather than on West Flagler Street. The emergency department is Homestead Hospital, and anything serious is transferred north to Ryder at Jackson Memorial, which leaves the medical records in two buildings. The report comes from Homestead Police, Florida City Police, the Miami-Dade Sheriff’s Office or the Florida Highway Patrol depending on which side of a city line the crash happened. Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people, according to the Florida Department of Highway Safety and Motor Vehicles. The law that governs the claim — the fourteen-day treatment deadline, the injury threshold, comparative fault — is explained in full on the Florida car accident page. What follows is the South Dade part.

Quick answers about Homestead car accident claims

Where will my case be heard?
Most South Dade matters go to the South Dade Justice Center at 10710 SW 211th Street, a branch of the Eleventh Judicial Circuit. A case from Homestead does not automatically mean a trip to West Flagler Street.
Which hospital will the records come from?
Homestead Hospital for the emergency department. Serious trauma is transferred north to Ryder Trauma Center at Jackson Memorial, so the records end up in two places and both are needed.
Who writes the crash report here?
Homestead Police inside the city, Florida City Police in Florida City, the Miami-Dade Sheriff’s Office in the unincorporated areas, and the Florida Highway Patrol on the Turnpike and the open stretches of US-1.
How do I get the report?
Through the FLHSMV crash portal, or from Homestead Police Records at 45 NW 1st Avenue. Under § 316.066(2)(a) a report containing personal information is confidential for 60 days, and § 316.066(2)(b) lets the parties and their legal representatives obtain it immediately.
What is the deadline I need to worry about today?
Fourteen days to receive initial medical care, or Personal Injury Protection pays nothing at all. Fla. Stat. § 627.736. It is the one deadline that runs out before most people have decided what to do.
The other driver had no insurance.
It is more common here than in most of the county. The claim moves to your own uninsured or underinsured motorist coverage, which is worth checking before anything else is decided.
Does the office handle Florida City and the Redland?
Yes. The Homestead office is the closest one for Florida City, Leisure City, Naranja, Princeton, Goulds and the Redland, and it is a few minutes from the courthouse.

01 The law, once

Which Florida laws apply to a Homestead car accident claim

The rules are the same across Florida, so they are written out in full on one page rather than repeated here. They are explained on the statewide car accident page, with the statute text linked.

The short version, because people need it before they click: treatment must begin within fourteen days or PIP pays nothing (§ 627.736). PIP then covers 80% of medical bills up to $10,000 regardless of fault. To recover pain and suffering from the at-fault driver you must clear the threshold in § 627.737 — significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability, significant and permanent scarring or disfigurement, or death.

Under § 768.81 you recover nothing if you are found greater than 50% at fault, a bar that does not apply to medical negligence claims. And the filing deadline is two years for claims accruing on or after March 24, 2023.

What follows is the part that is specific to Miami-Dade County — where these claims arise, where you will be treated, which courthouse the case goes to, and how the records are obtained.

02 The roads

Where car accident claims arise in Miami-Dade County

South Dade crashes do not look like the rest of the county. One highway carries everything north and everything to the Keys, one road carries the farm traffic, and between them are long rural stretches with no lighting and nobody around to see what happened.

  • US-1, South Dixie HighwayThe main route north and the only highway south to the Keys. The serious crashes in this area happen here more than anywhere else.
  • Krome Avenue, SR-997Agricultural and truck traffic, long rural stretches, limited lighting, and tractors entering from field roads.
  • Florida’s Turnpike, Homestead ExtensionHigh speed between Homestead and the rest of the county, ending at Palm Drive in Florida City.
  • Campbell Drive, SW 312th StreetThe main east-west through Homestead, carrying Turnpike and US-1 traffic across town.
  • Mowry Drive, SW 320th StreetDowntown Homestead’s other crossing, with turning traffic at every block.
  • Palm Drive, SW 344th StreetFlorida City’s main crossing and the end of the Turnpike, where Keys traffic meets local traffic.
  • SW 137th AvenueThe north-south between Homestead and Kendall, used as an alternative when US-1 is backed up.
  • Card Sound Road, SR-905AThe two-lane alternate to the Keys. Long, unlit, and used most when US-1 is already congested.

03 The courthouse

A South Dade case does not usually mean a trip downtown

The South Dade Justice Center at 10710 SW 211th Street is a branch of the Eleventh Judicial Circuit, and most matters arising in the south of the county are heard there rather than at the main courthouse on West Flagler Street. For somebody in Homestead or Florida City that is the difference between a short drive and most of a day.

It matters less often than people expect, because most injury claims never reach a courtroom at all. They resolve with the insurer, and filing is what happens when that fails. But where a case would be filed shapes how it is handled from the beginning, and it is a reasonable thing to ask about before hiring anyone.

The office is minutes away. Being close to the courthouse is not an argument about quality. It is an argument about how many of your days a case costs you.

04 The Keys funnel

Everything going south goes through here

US-1 below Florida City is the only highway to the Keys, with Card Sound Road as the single two-lane alternative. Every car heading to Key Largo and beyond passes through South Dade, and so does every car coming back.

That changes who is in the crash. A meaningful share of the traffic on US-1 here is from somewhere else — out of county, out of state, or in a rental. Which matters for a practical reason: the other driver may be insured somewhere with different limits, the rental company’s coverage may be involved, and a witness may be four hundred miles away by the time anybody asks.

It also changes when crashes happen. Friday afternoons, Sunday evenings, and the long weekends when the southbound lanes back up and the northbound ones do not. Congestion crashes are low speed and are routinely dismissed as minor, which is exactly the setting where a neck injury gets written off at the scene and diagnosed six weeks later.

Get the names at the scene. In a county where everybody lives nearby, a witness can be found later. Here they may genuinely be unreachable, and a photograph of a license plate is sometimes the only record that a car was there.

05 Krome and the farm traffic

The road that makes South Dade different

Krome Avenue, signed SR-997, carries the agricultural traffic of the whole area — packing trucks, equipment moving between fields, and vehicles entering from unpaved field roads that are not intersections in any designed sense.

Long stretches of it have no lighting and no shoulder worth the name. A crash at dusk on Krome, with a slow vehicle and a fast one, is the recurring pattern here, and it produces disputes about speed and visibility rather than about who hit whom.

Farm labor transport is part of the picture. Vans carrying crews to and from the fields are on these roads before sunrise, and a crash involving one is not a simple two-driver claim — there may be an employer, a commercial policy, and a workers’ compensation question running alongside the injury claim. That combination is worth identifying early, because the two tracks have different deadlines and the wrong order causes problems.

Commercial vehicles bring their own evidence. A truck involved in a crash may have maintenance records, hours-of-service logs and an employer behind it. That evidence does not wait, and the request for it has to go out before the ordinary retention period runs.

06 The coverage problem

More drivers here have nothing behind them

Florida does not require any driver to carry bodily injury liability coverage. A driver can be entirely legal with $10,000 of PIP, property damage coverage, and nothing at all that pays for an injury they cause.

In South Dade that is not a rare outcome, it is a common one. Which means the question that decides many of these claims is not what the other driver did. It is what your own policy says about uninsured and underinsured motorist coverage, and whether it stacks across the vehicles on it.

Most people have never read their own declarations page. It is one page, the insurer will send it on request, and it frequently contains the answer to the only question that turns out to matter. Where the coverage was rejected, the rejection had to be in writing, and it carries forward onto renewals at the same limits.

Do not settle with the at-fault insurer before checking. Where an underinsured motorist claim exists, settling the liability claim without notice to your own carrier can damage it, and the notice requirements are specific.

07 The medical records

Homestead Hospital, and the file that ends up in two buildings

Homestead Hospital is the emergency department for this area. It is where most people are taken and where the first record of the injury is created.

Serious trauma does not stay there. It is transferred north to Ryder Trauma Center at Jackson Memorial, one of the county’s two Level I trauma centers. When that happens the medical file is split across two institutions, and a claim built on only one of them is missing either the first assessment or everything that followed it.

That split is also where treatment gaps come from. Somebody discharged from Jackson with instructions to follow up has to get back to South Dade to do it, and the follow-up that does not happen reads in the record as a recovery rather than as a transport problem. It is worth saying out loud to the treating doctor when it is the reason.

Ask for both files early. They are not automatically shared, and the request takes time that is cheaper to spend now than at the end.

08 Examples of situations

Situations this office sees in Miami-Dade County

The following are examples of the kinds of situations that arise in this county. They are illustrations of how the rules apply, not descriptions of past cases, and they do not predict any outcome. Every claim turns on its own facts, its own coverage and its own medical record.

  • The Sunday evening backup on US-1

Northbound traffic returning from the Keys stops, and the car behind does not. Low speed, modest damage, no ambulance, and both drivers agree at the scene that nobody is hurt. The neck stiffens by Tuesday and the fourteen-day window is already running.

  • Dusk on Krome

A packing truck turning out of a field road and a car at highway speed. The dispute is about whether the truck was visible, and it is resolved with the physical evidence rather than with the two accounts.

  • The rental car from out of state

A visitor on the way to Key Largo, driving a rental, on an unfamiliar road. The coverage question is layered — the renter, the rental company and any policy that follows the driver — and it takes longer to establish than a local crash.

  • The crew van before sunrise

A vehicle carrying workers to the fields is struck on SW 137th Avenue. There is an employer, a possible commercial policy and a workers’ compensation question running alongside the injury claim, and the order the two are handled in matters.

09 The evidence

Evidence that exists here and often goes uncollected

Almost every camera that saw the crash overwrites itself within days or weeks. The difference between a disputed liability case and a straightforward one is usually whether someone asked for the footage while it still existed.

  • Photographs before anything moves

Both vehicles, their positions, the lane markings, the lighting and the road surface. On an unlit stretch of Krome or Card Sound, a photograph of what could actually be seen is evidence nobody can reconstruct later.

  • The names at the scene, not later

Witnesses on US-1 here are frequently from somewhere else and genuinely unreachable a week later. A phone number taken at the roadside is worth more than it looks.

  • The agency and the report number

Four different agencies work crashes in this area. Knowing which one wrote the report saves weeks of requesting from the wrong place.

  • Both sets of medical records

Homestead Hospital for the emergency department, and Jackson for anything that was transferred. A claim built on one of them is incomplete.

  • Your own declarations page

Uninsured and underinsured motorist coverage, and whether it stacks. In an area where many drivers carry no bodily injury coverage, that single sheet is frequently the whole claim.

  • Anything commercial

A truck’s USDOT number, the company name on the door, the plate. That thread leads to maintenance records and logs that are not kept forever.

10 The report

Getting the crash report in South Dade

Which agency wrote it depends on where the crash happened. Homestead Police inside the city limits, Florida City Police in Florida City, the Miami-Dade Sheriff’s Office in the unincorporated areas between them, and the Florida Highway Patrol on the Turnpike and the open stretches of US-1. The agency and the report number are the two things worth writing down at the scene.

Reports are available through the FLHSMV crash portal, usually within about ten days. Homestead Police Records is at 45 NW 1st Avenue in Homestead for a report that agency worked.

The 60-day rule catches people out. Under § 316.066(2)(a) a crash report that reveals personal information is confidential for 60 days after it is filed. Section 316.066(2)(b) lets the parties involved and their legal representatives obtain it immediately — so being told to wait two months is usually a misunderstanding about which category you are in.

Read it for what it gets wrong. A report is one officer’s account written at the roadside, and the diagram, the direction of travel and the narrative are all things that get corrected later when the physical evidence does not match.

Homestead car accident questions, answered

Do I need a lawyer for a car accident in Homestead?

Not for every crash. Where nobody is hurt and the property damage is straightforward, people handle it themselves and should.

Where there is an injury, the questions that decide the claim — whether treatment began inside fourteen days, whether the injury clears the threshold in § 627.737, what coverage actually exists, and what share of the fault gets attached to you — are the ones people do not know to ask until it is late.

Will I have to go to the courthouse downtown?

Usually not. Most South Dade matters are heard at the South Dade Justice Center at 10710 SW 211th Street, which is a branch of the same circuit.

And most injury claims resolve without a lawsuit at all, so the question often does not arise.

I was taken to Homestead Hospital and then transferred. Does that complicate things?

It splits the medical file across two institutions, which is a practical problem rather than a legal one. Both sets of records are needed, and they are not automatically shared.

It also tends to produce an apparent gap in treatment, because following up with a Jackson specialist from Homestead is a real logistical burden. Where that is the reason for a gap, it is worth telling the treating doctor so the record says so.

The other driver has no insurance. Is that the end of it?

No, and it is common in this area. The claim moves to your own uninsured or underinsured motorist coverage, which Florida requires on every bodily injury policy unless a named insured rejected it in writing.

Pull your declarations page before deciding anything, and do not settle with the at-fault carrier before your own insurer has been notified.

The crash was on the Turnpike. Is that different?

Only in who wrote the report — the Florida Highway Patrol rather than a city department — and in the speeds involved, which tend to make the injuries worse.

The claim itself runs on the same rules, and the case is still heard in Miami-Dade.

What does it cost to ask?

The consultation is free and the representation is on a contingency fee, generally payable only on recovery. Case expenses are governed by the written agreement.

The conversation is with Jose A. Dapena, not an intake department.
