Car accident lawyer in Tamiami

Where the Tamiami Trail stops being a city street

A crash in Tamiami is a Miami-Dade County claim under the same Florida law as anywhere else: fourteen days to get initial care, the injury threshold, two years to sue. What is local is the road the place is named for. US-41, the Tamiami Trail, runs straight through the middle: east it becomes SW 8th Street and the city, west it runs about 95 miles through the Everglades to Naples with almost nothing on it. Tamiami is where the Trail stops being a city street, and a crash on one side of that transition is a different event from a crash on the other — different speeds, different agency, and a very different wait for an ambulance. The statutes are on the Florida car accident page. What follows is about that road.

01 What a crash here actually looks like

The last of the grid, and then nothing

Tamiami is named for the road. The Trail was built to link Tampa and Miami, and the community took the blended name. Within the community it is a signalized six-lane arterial with shopping centers, schools and 54,212 residents either side of it.

A few miles west, the same road changes completely. It narrows, the lighting ends, the shoulder goes, and the next town is 95 miles away. Drivers do not slow down for the transition, which is the whole problem: a road that looks continuous behaves like two different roads.

The community filled up fast and then stopped. 17,607 residents in 1980 became 33,845 in 1990 and 54,788 in 2000, and it has barely moved since — 54,212 in 2020, with 2.2% of housing vacant. It is fully built out, and it has aged: the median age is 47.0, the oldest of the communities around it.

It is settled rather than transient. Of 17,620 housing units only 2.2% sit vacant, 32.1% of households have children under 18, and the median age is 47.0 — three generations using the same arterial at the same hours of the day.

A road that looks continuous behaves like two different roads.

02 What nobody tells you

West of here, the clock that matters is the ambulance

Every injury claim in Florida depends on records made in the first hours. On the developed stretch of the Trail that is not a problem — HCA Florida Kendall, the Level I trauma center for the west and south of Miami-Dade, is a straightforward drive, and Ryder at Jackson Memorial is the county’s other Level I center.

West of the community it becomes the dominant fact. On the Everglades stretch there is no nearby hospital, response times are long, and a serious injury may be flown rather than driven. That changes the outcome, the records and the size of the claim, and it is why where exactly on US-41 a crash happened is the first thing worth establishing.

Tamiami is unincorporated, so the Miami-Dade Sheriff’s Office works the crash. On US-41, a state road, the Florida Highway Patrol may work it instead, and on the remote western stretch the Highway Patrol is normally the agency. Sweetwater, with its own police department, begins to the northeast.

If the road itself is part of the claim, the state is the defendant. US-41 is a state road, which puts the claim under § 768.28: written notice first, to the agency and to the Florida Department of Financial Services both, three years to give it and two on a wrongful death claim, with caps of $200,000 per person and $300,000 per incident. The county holds the local streets, and a claim against a county needs no notice to the Department at all.

A Tamiami case is filed in the Eleventh Judicial Circuit. Most injury claims are resolved with the insurer before any lawsuit is filed.

03 The roads

Where the claims actually come from

US-41, the Tamiami Trail, straight through the middle: six lanes, signalized, with a commercial driveway or a school entrance at almost every block.

US-41 west of the development, the same road without the lights, the shoulder or the help, where a single-vehicle crash can go unreported for a long time.

SW 137th Avenue, the north-south route that carries the community between the Trail and Bird Road.

The school approaches, where arrival and dismissal put pedestrians, buses and parent traffic onto an arterial twice a day, in a community with a large school-age population and a large population over 65 sharing the same crossings.

The shopping center entrances along the Trail, where the left turn across six lanes is the single most common way a claim here begins.

04 What to do now

The things that can only be done in the first two weeks

A checklist, not advice about your own case. None of it requires hiring anyone.

  1. Get seen within fourteen days

Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. If you were taken from a remote stretch of the Trail, the transport records matter as much as the treatment records.

  2. Fix the point on US-41 exactly

A mile marker, a cross street, the nearest business. On this road the location decides the speed limit, the lighting, the responding agency and the response time, and all four end up in the claim.

  3. Note the agency and the report number

The Miami-Dade Sheriff’s Office across unincorporated Tamiami, the Florida Highway Patrol on US-41 and almost always on the western stretch. The report is requested the same way whichever one wrote it.

  4. Keep everything from the transport

Ambulance or air transport generates its own record and its own bill. Both belong in the file, and the decision to fly someone is itself evidence about the severity of the injury.

  5. Pull your own declarations page

Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.

  6. Do not give the other insurer a recorded statement

You are not required to. The answer given in the first week gets quoted back for the next two years.

05 The kinds of claim this covers

One road, two personalities, four claims

Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people and killing 272, according to the Florida Department of Highway Safety and Motor Vehicles, and the county’s Vision Zero program counts about 99 pedestrian deaths a year. No published count exists for Tamiami alone. What a built-out community on the edge of the Everglades produces is the local part.

Car accidents

The bulk of it, and on the developed stretch it is the left turn into a shopping center across six lanes of arterial traffic. West of the development it becomes speed, fatigue and a road with nowhere to go.

Pedestrian accidents

Schools and shopping on both sides of a six-lane arterial, in a community with both a large school-age population and the oldest median age around. These cases turn on how fault is divided, and more than half the fault means recovering nothing at all.

Wrongful death

The remote stretch of US-41 produces outcomes the developed stretch does not, because the distance to care is part of the injury. A wrongful death claim in Florida is brought by the personal representative of the estate rather than by family members individually, and § 768.21 sets out who may recover and for what — which is why the first conversation is about the estate as much as about the crash.

Uninsured drivers

A road that crosses the state brings drivers from everywhere, carrying whatever their own state or their own budget required. Florida requires no bodily injury liability coverage at all, so the underinsured case is the ordinary one and your own policy is what fills the gap.

06 Also for Tamiami

The other matters this office takes from here

Injury work is most of this practice. The rest run from the South Miami office, each with its own page and its own fee terms.

Immigration

Removal defense, bond, asylum, family petitions and citizenship. Which court holds a case is decided by the file rather than by the address on it, so living at the western edge of the county changes nothing about where a case is heard.

Property insurance claims

A community built out between 1980 and 2000 is now at the age where the original roof and the original plumbing both reach the end at once, and the insurer calls that wear rather than a covered loss. Notice of the claim is due within one year of the date of loss.

Family law

Divorce, time-sharing, support, property and protective orders in the Eleventh Judicial Circuit.

Criminal defense

Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the Sheriff rather than by a city department.

07 How this works

The consultation, the documents, and what it costs

The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.

The Miami office is at 5975 Sunset Drive, Suite 102, in South Miami, east of here along the same road the community is named for. There is parking on site.

Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

08 Who you deal with

Jose A. Dapena

Admitted to The Florida Bar in 1998, number 152358, and admitted to the United States District Courts for the Southern, Middle and Northern Districts of Florida.

Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf: the same analysis a claim meets now, learned from the other side of the file.

Questions

Who writes the crash report in Tamiami?

The Miami-Dade Sheriff’s Office across the unincorporated community. On US-41, which is a state road, the Florida Highway Patrol may work it instead, and on the western stretch beyond the development the Highway Patrol is normally the agency. Whichever wrote it, the report is requested through the FLHSMV crash portal.

My crash was out on the Trail, west of everything.

Then the location is the most important fact in the file. Speeds are higher, there is no lighting or shoulder, response times are long, and a serious injury may be flown rather than driven. All of that affects the injury itself and the records that prove it, so fix the point as precisely as you can — a mile marker, a landmark, anything.

Which hospital would I be taken to?

From the developed part of Tamiami, HCA Florida Kendall is the Level I trauma center for the west and south of Miami-Dade; Ryder at Jackson Memorial is the county’s other Level I center. A child is normally taken to Nicklaus Children’s rather than to an adult trauma center.

Someone in my family was killed. Who brings that claim?

In Florida a wrongful death claim is brought by the personal representative of the estate under § 768.20, not by family members individually, and § 768.21 sets out who may recover and for what. That means part of the first conversation is about opening the estate, which is a step families are often not told about until months have passed.

Is there an office in Tamiami?

No. The office is at 5975 Sunset Drive, Suite 102, in South Miami, east of here, and it serves all of Miami-Dade.

Where would my case be heard?

In the Eleventh Judicial Circuit, which covers all of Miami-Dade County. Most injury claims are resolved without a lawsuit.

How long do I have?

Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims, wrongful death included. If a government road authority is the defendant there is a separate clock: written notice within three years, or within two on a wrongful death claim, and on a state road that notice goes to the Florida Department of Financial Services as well as to the agency.
