Car accident lawyer in South Miami Heights

Close to a trauma center, and why the first record still decides everything

A crash in South Miami Heights is a Miami-Dade County claim under the same Florida law as anywhere else: fourteen days to get initial care, the permanent injury threshold, two years to sue. What is local is that help is close. With 36,770 residents it is the largest community in this part of the county, and Jackson South Medical Center — the Level II trauma center on SW 152nd Street — is minutes north rather than a long ride away. That removes the problem the rest of south Miami-Dade has and replaces it with a different one. When the ambulance is quick and the hospital is near, the claim no longer turns on how long care took to arrive. It turns on what the record of that care actually says, and in Florida one line in it decides whether your Personal Injury Protection is worth $10,000 or $2,500. The statutes are on the Florida car accident page. What follows is about the record.

01 What a crash here actually looks like

The biggest community down here, and one that has stopped growing

South Miami Heights is the largest of these communities and the steadiest. 10,395 residents in 1970, 23,559 in 1980, 30,030 in 1990, 33,522 in 2000, 35,696 in 2010 and 36,770 in 2020 — a 3.0% decade, after decades of doubling. It is built out, across 12,007 housing units with 3.4% vacant and homeowner vacancy at just 0.6%.

Which means it has aged in place. The median age is 42.8, 18.6% of residents are 65 or over and 19.7% are under 18. 76.76% of residents are Hispanic or Latino, 14.37% are non-Hispanic Black, 5.76% are non-Hispanic White and 1.21% are non-Hispanic Asian — the broadest mix of the communities around it.

It was called Eureka before it was called this. It sits about 17 miles southwest of downtown Miami, bordered by Cutler Bay to the east, Goulds to the south, Richmond West to the northwest, West Perrine to the northeast, and Zoo Miami and Thompson Memorial Park along the north.

And it is dense without being crowded onto a highway. 36,770 people on 4.91 square miles of land is about 7,492 per square mile, spread across a residential grid rather than strung along a single corridor — so most crashes here happen among neighbors, at ordinary speeds, within a few minutes of a trauma center.

When care is close, the fight moves from the ambulance to the chart.

02 What nobody tells you

One line in the first medical record is worth $7,500

Personal Injury Protection is not a flat $10,000. Under § 627.736(1)(a)3 the benefit reaches $10,000 only where a physician, a dentist, a physician assistant or an advanced practice registered nurse determines that the injured person had an emergency medical condition. Where a provider instead determines that it was not one, § 627.736(1)(a)4 limits reimbursement to $2,500.

And the two determinations do not come from the same list. The finding that it was an emergency medical condition can only come from that short group of providers. The finding that it was not can come from a wider group, chiropractic physicians among them. So a course of treatment that begins and stays outside that short list can leave the file with no determination that reaches the full benefit, which is a paperwork problem rather than a medical one and is fixable early and almost unfixable late.

The fourteen days still govern everything. Section 627.736(1)(a) pays nothing at all unless initial services and care are received within 14 days of the crash. Being close to a hospital makes that easy to satisfy and easy to assume — and people who feel bruised on the day still skip it.

Two more things the statute says that surprise people. Massage therapy and acupuncture are excluded from medical benefits entirely under § 627.736(1)(a)5, whoever provides them. And the $5,000 death benefit in § 627.736(1)(c) is in addition to the medical and disability benefits rather than carved out of them.

South Miami Heights is unincorporated, so the Miami-Dade Sheriff’s Office works the crash. If a road authority is the defendant, § 768.28 applies, with written notice to the agency and — where the defendant is the state rather than the county — to the Florida Department of Financial Services as well. A case here is filed in the Eleventh Judicial Circuit.

03 The roads

Where the claims actually come from

SW 152nd Street, Coral Reef Drive, the east-west route along the north side, carrying hospital traffic to Jackson South along with everything else.

The residential grid, which is where most of it happens: 36,770 people on under five square miles, mostly meeting each other at intersections inside their own neighborhood at ordinary speeds.

The commercial entrances, where a left turn across traffic into a plaza is the single most repeated movement in any claim from a built-out suburban community.

The Zoo Miami and Thompson Memorial Park approaches, along the north, where visitor traffic unfamiliar with the area mixes with residents who drive these streets every day.

The school approaches, in a community where 19.7% of residents are under 18 and 18.6% are 65 or over, so children and older residents use the same crossings at the same hours.

04 What to do now

The things that can only be done in the first two weeks

A checklist, not advice about your own case. None of it requires hiring anyone.

  1. Get seen within fourteen days, and go to a hospital if there is any doubt

Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days. Jackson South on SW 152nd Street is minutes away and is a Level II trauma center, so there is no good reason to wait and see.

  2. Ask whether an emergency medical condition was determined, and by whom

That determination is what opens the full $10,000 under § 627.736(1)(a)3, and it can only come from a physician, dentist, physician assistant or advanced practice registered nurse. Knowing in week one whether it exists is far better than discovering in month four that it does not.

  3. Keep every discharge paper

The emergency department record, the imaging, the discharge instructions and the referrals. They are the documents a claim is built on, and they are easier to collect while you still have the folder than from a records department later.

  4. Do not expect massage or acupuncture to be covered

Section 627.736(1)(a)5 excludes both from medical benefits entirely, whoever provides them. Money spent there does not come back through PIP.

  5. Ask the county for the report

South Miami Heights is unincorporated, so the Miami-Dade Sheriff’s Office wrote it. The report is requested through the FLHSMV crash portal.

  6. Pull your own declarations page

Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.

  7. Do not give the other insurer a recorded statement

You are not required to. The answer given in the first week gets quoted back for the next two years.

05 The kinds of claim this covers

What a built-out suburban community produces

Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people and killing 272, according to the Florida Department of Highway Safety and Motor Vehicles, and the county’s Vision Zero program counts about 99 pedestrian deaths a year. No published count exists for South Miami Heights alone. What 36,770 people on a residential grid near a trauma center produce is the local part.

Car accidents

Mostly neighbor meeting neighbor: the intersection, the left turn into a plaza, the driver pulling out of a lot. Lower speeds than a highway crash, and the case tends to be decided by the medical record rather than by the physics.

Pedestrian accidents

19.7% of residents are under 18 and 18.6% are 65 or over, and both groups walk the same crossings. These cases turn on how fault is divided, and more than half the fault means recovering nothing at all.

Truck accidents

Delivery and service vehicles working a community of 12,007 households, on residential streets rather than a freight corridor. A commercial vehicle triggers a long-form crash report under § 316.066(1)(a) regardless of injury, and brings federal driving and inspection records with it.

Work injuries

Where someone other than your employer caused the injury — another contractor, a delivery driver, a property owner — that is a separate claim against that third party, and it is the one most people are never told about.

06 Also for South Miami Heights

The other matters this office takes from here

Injury work is most of this practice. The rest run from the Homestead office, each with its own page and its own fee terms.

Property insurance claims

12,007 homes, almost none of them vacant, in a community that finished building decades ago — which is the age at which the original roof and the original plumbing reach the end at once, and the insurer calls that wear rather than a covered loss. Notice of the claim is due within one year of the date of loss.

Immigration

Removal defense, bond, asylum, family petitions and citizenship. Which court holds a case is decided by the file rather than by the address on it.

Family law

Divorce, time-sharing, support, property and protective orders in the Eleventh Judicial Circuit.

Criminal defense

Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the Sheriff rather than by a city department.

07 How this works

The consultation, the documents, and what it costs

The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone. Bring the discharge paperwork if you have it.

The Homestead office is at 100 NE 15th Street, Suite 210, about twelve miles south. There is parking on site.

Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

08 Who you deal with

Jose A. Dapena

Admitted to The Florida Bar in 1998, number 152358, and admitted to the United States District Courts for the Southern, Middle and Northern Districts of Florida.

Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf. Deciding what a medical record did and did not establish is exactly the work he did from the other side of the file.

09 The law behind this

  • Fla. Stat. § 627.736(1)(a) The fourteen days, and $10,000 or $2,500

Benefits are payable only where initial services and care are received within 14 days. Subparagraph 3 reaches $10,000 only where a physician, dentist, physician assistant or advanced practice registered nurse determines there was an emergency medical condition; subparagraph 4 limits reimbursement to $2,500 where a provider determines there was not.

  • Fla. Stat. § 627.736(1)(a)5 What PIP never pays for

Massage therapy and acupuncture are excluded from medical benefits entirely, regardless of who provides them, and neither a licensed massage therapist nor a licensed acupuncturist may be reimbursed.

  • Fla. Stat. § 627.737(2) The permanent injury threshold

Pain and suffering are recoverable from the at-fault driver only on permanent injury, significant permanent scarring or disfigurement, or death. Below it, the claim is economic loss and nothing else.

  • Fla. Stat. § 768.81 Fault

Damages are reduced by your share of the fault, and more than 50% of the fault bars recovery entirely.

  • Fla. Stat. § 95.11 Deadlines

Two years to sue on most negligence claims accruing on or after March 24, 2023, and two years on a wrongful death claim.

Questions

My PIP paid out at $2,500. I thought it was $10,000.

Both numbers are in the statute. Section 627.736(1)(a)3 reaches $10,000 only where a physician, dentist, physician assistant or advanced practice registered nurse has determined that the injured person had an emergency medical condition. Section 627.736(1)(a)4 limits reimbursement to $2,500 where a provider determines there was not one. The first thing to check is whether such a determination exists in the file and who made it.

Can my chiropractor make that determination?

A chiropractic physician can lawfully provide initial and follow-up care under § 627.736(1)(a)1 and 2. But the determination that the injury was an emergency medical condition — the one that opens the full $10,000 — can only come from a physician, a dentist, a physician assistant or an advanced practice registered nurse. The determination that it was not can come from a wider group, chiropractic physicians among them. That asymmetry is in the statute, and it catches people out.

Which hospital would I be taken to?

Jackson South Medical Center on SW 152nd Street, just north, is a Level II trauma center and is the closest one. The county’s two Level I centers are Ryder at Jackson Memorial and HCA Florida Kendall; a child is normally taken to Nicklaus Children’s. The levels come from the Florida Department of Health’s verified list.

Will PIP cover my massage therapy?

No. Section 627.736(1)(a)5 excludes massage therapy and acupuncture from medical benefits entirely, regardless of who provides them, and neither a licensed massage therapist nor a licensed acupuncturist may be reimbursed under the section. It is one of the few flat exclusions in the statute.

Who writes the crash report in South Miami Heights?

The Miami-Dade Sheriff’s Office, because the community is unincorporated. The report is requested through the FLHSMV crash portal, and under § 316.066(2) the people involved and their legal representatives can obtain it immediately rather than waiting out the 60-day confidentiality period.

Is there an office in South Miami Heights?

No. The Homestead office is at 100 NE 15th Street, Suite 210, about twelve miles south, and it serves all of south Miami-Dade. The first conversation can happen by phone.

Where would my case be heard?

In the Eleventh Judicial Circuit, which covers all of Miami-Dade County. Most injury claims are resolved without a lawsuit.

How long do I have?

Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims, wrongful death included. If a road authority is the defendant there is a separate clock: written notice within three years, or within two on a wrongful death claim, and where the defendant is the state that notice goes to the Florida Department of Financial Services as well as to the agency.
