Drug trafficking in Florida

Trafficking is a weight, not an activity, and nobody has to have sold anything

Almost everyone charged with trafficking in Florida says the same thing: I was not selling anything. That is frequently true and it is not a defense. Under Fla. Stat. § 893.135, trafficking is triggered by knowingly possessing a threshold quantity of a controlled substance. No sale, no distribution and no organization is required. What makes it the most serious drug charge in the state is that each threshold carries a mandatory minimum prison term and a fine that a judge has no discretion to go below.

01 Quick answers

Do I have to have sold something?
No. Knowingly possessing the threshold weight is enough. Selling, delivering, manufacturing and importing are also covered, but possession alone will do it.
What is a mandatory minimum?
A prison term fixed by statute that the judge cannot sentence below, regardless of your record, your role or the circumstances.
Does the weight include the mixture?
For many substances the statute is written around the weight of a mixture containing the substance, not the pure drug — which is why total weight matters so much.
Does my role matter?
Not to the mandatory minimum. The driver, the holder and the organizer can face the same floor. That is the feature of the statute that surprises people most.
Is there any way below the minimum?
Narrow routes exist, including substantial assistance, and they have real costs and real risks that have to be understood before anyone agrees to anything.
What about prescription pills?
Many trafficking cases involve prescription medication, and the thresholds for some of those are low enough to be reached by a quantity people do not regard as large.

02 What it means

Trafficking is a weight, not a business

The word does almost all of the damage. "Trafficking" sounds like an enterprise — distribution, customers, organization. Florida does not define it that way.

Section 893.135 makes it trafficking to knowingly sell, purchase, manufacture, deliver, bring into the state, or be in actual or constructive possession of a listed quantity of a controlled substance. The possession route is the one that catches people, and it requires nothing else at all.

Each substance has its own thresholds, and each threshold has its own mandatory minimum and fine. Crossing from one tier to the next is a matter of weight, which means the difference between two sentences can be a few grams, decided by a scale rather than by anything a person did.

For many substances the statute is written around a mixture containing the drug rather than the pure drug. That is why the whole weight of what was seized matters, and why the composition of what was in a bag can be the entire case.

The difference between two sentences can be a few grams, decided by a scale rather than by anything anyone did.

03 Possession

Constructive possession, and the case built on a location

Possession does not require that anything was in your hand. Constructive possession reaches a person who knew the substance was present and had the ability to control it — which is how a charge is built from a car with several people in it, a shared apartment or a package.

That is also where these cases are won. Mere proximity is not possession. In a vehicle with four occupants and a bag under a seat, the question is what connects a particular person to it: fingerprints, messages, admissions, ownership, who had keys, who rented the room. Where the only answer is that they were present, the case has a real problem.

Knowledge has to be proven too. Someone who did not know the substance was there is not in possession of it, and that is a question of evidence rather than of assertion.

The practical consequence is that the first account given matters enormously. "It is not mine but I knew it was there" is an admission that supplies an element the State would otherwise have to prove.

04 The search

How the evidence was obtained is usually the real issue

In most trafficking cases the substance exists and the weight is what it is. The contested ground is not whether it was there; it is whether the State may use it.

The stop. A traffic stop needs a lawful basis, and the stated reason is testable against the video and the timing. A stop extended beyond its purpose while waiting for something else has its own problems.

The search. Consent, a warrant, probable cause, an inventory, or a dog. Each has requirements. Consent has to be voluntary and its scope matters. A warrant rests on an affidavit that can be examined. An alert from a dog depends on training and reliability records that are obtainable.

The statements. When questioning became custodial interrogation determines whether warnings were required, and that is frequently a closer question than the report suggests.

The weighing and testing. How the substance was weighed, whether packaging was included, how it was stored, who handled it, and what the laboratory actually tested and reported. Where a tier boundary is close, the weighing method is not a technicality — it is the sentence.

05 What can be done

The routes that exist, and what they cost

The honest version of this is that a mandatory minimum removes the usual tools. Mitigation that would move an ordinary sentence does not move a floor. So the work goes into the elements and the evidence rather than into sympathy.

Suppression — if the stop or the search fails, the substance may be unusable, and that ends the case rather than softening it.

The weight — challenging the method, the inclusion of packaging or filler, and the laboratory’s analysis. Dropping below a threshold changes the statute that applies, not just the number of years.

Possession and knowledge — where the connection to a person is proximity rather than evidence.

Substantial assistance is the statutory route below a minimum, and it is the one that needs the most careful conversation. It has genuine risks, it depends on what a person actually knows, and it is not something to agree to in principle before the terms are concrete.

For anyone who is not a United States citizen, a controlled substance conviction is among the most damaging in immigration law, and a trafficking conviction more so. That has to be on the table from the first meeting, because it changes which outcomes are acceptable.

06 The statutes

  • Fla. Stat. § 893.135 Trafficking The conduct, the thresholds by substance, and the mandatory minimum terms and fines.
  • Fla. Stat. § 893.13 Prohibited acts Possession, sale and intent to sell — the offenses below the trafficking thresholds.
  • Fla. Stat. § 893.03 Controlled substance schedules Which substances are listed and in which schedule, which the thresholds depend on.
  • Fla. Stat. § 775.087 Firearm enhancements What a firearm found in the same case adds, and why it is charged separately.

Drug trafficking questions, answered

I was not selling anything. Does that help?

It is usually true and it is usually not a defense, because the statute does not require a sale. Knowingly possessing the threshold quantity is enough on its own.

Where it does matter is in negotiation and in the broader picture of the case, but it will not defeat the charge by itself.

It was not mine. I was just in the car.

Then the question is what the State can use to connect you to it beyond being present, because mere proximity is not possession. Fingerprints, messages, who rented the car, who had keys, what was said at the scene.

This is one of the most commonly winnable issues in these cases, and it is damaged most by explaining at the roadside.

It was prescription medication.

Many trafficking charges involve prescription pills, and some of those thresholds are reached by a quantity that does not look large to the person holding it. A valid prescription matters and its scope matters.

Bring the prescription records to the first meeting.

Can the judge give me less than the minimum?

Not on their own. A mandatory minimum is a floor the court cannot go below. The narrow statutory routes below it, including substantial assistance, carry real conditions and real risks and should be understood fully before anyone agrees to anything.

They are offering a deal if I cooperate.

That is a decision with consequences beyond the case, and it should be made with the terms written down rather than described. What is expected, what it is worth, what happens if it does not produce what the State hoped for.

Do not agree in principle in a room without counsel. The value of what someone knows is at its highest before they have given it away.

What does this cost?

Handled on a flat fee set by the charges and the scope, with no payment plans. Trafficking cases carry a different scope from a possession case because the work is different — suppression, weight, laboratory analysis — and that is set out before anything is signed.
