Car accident lawyer in Cutler Bay
A town with the courthouse inside it and no police department of its own
A crash in Cutler Bay is a Miami-Dade County claim, and the law that decides it is the same law as anywhere in Florida: the fourteen-day deadline for initial care, the injury threshold, two years to sue. What is unusual here is the arrangement. Cutler Bay is a town, incorporated in 2005, but it has never had a police department of its own — the county polices it under contract. The courthouse that would hear a south-county case, on the other hand, is inside the town. People get both of those backwards, and the first one costs time on a report request. The statutes are set out on the Florida car accident page. What follows is about the town.
01 What a Cutler Bay crash actually looks like
US-1, a busway in its own lanes, and the end of the Turnpike
US-1 runs the length of the town and carries almost everything, including through traffic headed for Homestead and the Keys. It is wide, it moves at highway speeds between signals, and the signals are far enough apart that people cross between them.
The South Dade TransitWay runs alongside it in its own dedicated lanes, and it crosses the surface streets at grade. That is the pattern worth knowing about here: a driver turning across US-1 is watching for cars in the traffic lanes and a bus arrives in a lane that carries nothing else. It is a predictable collision and it happens at the same intersections.
Florida’s Turnpike ends just south of here, which means traffic that has been moving at seventy miles an hour for an hour arrives on local roads in a few hundred yards and does not always adjust.
Caribbean Boulevard, Old Cutler Road and the 211th Street corridor carry the local traffic, through residential blocks, the town center and the retail strips, where the collisions are the ordinary turning and following ones at moderate speed.
A bus arriving in a lane that carries nothing but buses is the collision drivers here do not expect.
02 The part nobody tells you about Cutler Bay
The town has no police force, and the courthouse is on its own streets
Cutler Bay was incorporated on November 9, 2005, which makes it the youngest municipality in Miami-Dade County. Being a town changes some things and not others, and people usually guess wrong about which.
It does not have its own police department. Policing is provided by the county under an interlocal agreement, and the agency’s South District Station sits in the town. So a crash on a Cutler Bay street produces a county report — from the Miami-Dade Sheriff’s Office — and not a town one. Someone looking for a “Cutler Bay Police” report is looking for a document that does not exist.
The courthouse, on the other hand, is here. The South Dade Justice Center at 10710 Southwest 211th Street is in Cutler Bay, and it is the branch that hears matters from the south of the county rather than sending them downtown to West Flagler Street. For anyone in the far south of Miami-Dade, that is the difference between a short drive and a long one.
The town is still its own government where it is the defendant. A claim against the Town of Cutler Bay — a town vehicle, or a dangerous condition on a street the town maintains — runs under Fla. Stat. § 768.28: written notice within three years, six months for the town to respond before suit, and recovery capped at $200,000 for one person and $300,000 for the incident. The period to file is four years rather than two.
And US-1 and the Turnpike are state roads, which means a crash on them is usually a Florida Highway Patrol report even though it happened within the town limits.
03 The roads
Where the claims actually come from
US-1, the spine of the town, carrying local and Keys-bound traffic at highway speeds between widely spaced signals.
The South Dade TransitWay, in dedicated lanes beside US-1, crossing the surface streets at grade.
Florida’s Turnpike, whose southern end is just below the town, delivering highway-speed traffic onto local roads.
Caribbean Boulevard and Southwest 211th Street, the east-west pair through the town center and past the courthouse.
Old Cutler Road, two lanes, curved and heavily canopied, where the sightlines are genuinely short and the speeds are higher than they look.
04 What to do now
The things that can only be done in the first two weeks
A checklist rather than advice about your own case, and nothing in it requires hiring anyone.
Get seen within fourteen days
Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. It is the deadline that expires before most people have decided what to do.
Ask the county, not the town
Cutler Bay has no police department. The report comes from the Miami-Dade Sheriff’s Office, whose South District Station is in the town, or from the Florida Highway Patrol if it happened on US-1 or the Turnpike. Write down the agency and the report number at the scene.
Say whether a bus was involved
A transit vehicle means a public entity, and that is the § 768.28 route: written notice, a waiting period, and caps. It is a different claim from one against a private driver and it starts with a notice rather than a demand.
Photograph the crossing, not just the cars
Where the busway crosses a street, what matters is what each driver could see of the dedicated lane from where they were stopped. That is a photograph taken from the driver’s seat, and nobody takes it later.
Get names at the scene
US-1 through here carries a great deal of traffic that is passing through on its way south. A witness who was passing through is a witness nobody finds afterward.
Pull your own declarations page
Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.
Do not give the other insurer a recorded statement
You are not required to. The answer given in the first week gets quoted back for the next two years.
05 The kinds of crash this covers
The same roads, five different claims
Miami-Dade County recorded roughly 60,000 traffic crashes in 2024, with 29,359 people injured, according to the Florida Department of Highway Safety and Motor Vehicles. That is a county figure: there is no published count for Cutler Bay alone, and anyone quoting one is estimating. Which of them this stretch of US-1 produces is the local part.
Car accidents
The bulk of it, and along US-1 the pattern is turning across lanes and rear-end collisions in the queues that build between widely spaced signals.
The fourteen-day deadline applies to every one of them, whoever was at fault.
Pedestrian accidents
US-1 is wide and fast with long distances between crossings, and the busway adds a second set of lanes for someone on foot to misjudge.
These turn on how fault is divided, and more than half the fault means recovering nothing at all.
Truck accidents
Freight moving south to Homestead, Florida City and the Keys passes through here, and a loaded truck at highway speed on a surface road is a different injury from a car at the same speed.
It is also a different case: a company behind the driver, a USDOT number, and records kept for a defined period and then lawfully destroyed.
Uninsured drivers
Florida requires no driver to carry bodily injury liability coverage at all, so the underinsured case — limits smaller than the harm done — is the common one rather than the exception.
The claim moves to your own policy, which makes the declarations page the most important document in the file.
Workplace accidents
Retail, warehousing and the agricultural traffic heading further south all produce injuries on someone else’s premises.
This office does not take workers’ compensation cases. It takes third-party injury claims — against a negligent contractor, a property owner or an equipment maker — which can run alongside a compensation claim rather than instead of it.
06 Also for Cutler Bay
The other matters this office takes from here
Injury work is most of this practice. The rest are handled from the Homestead office, each with its own page and its own fee terms.
Immigration
Removal defense, bond, asylum, family petitions and citizenship, before the Miami and Krome courts, both of which are closer to Cutler Bay than the downtown civil courthouse is.
Family law
Divorce, time-sharing, support, property and protective orders — and many south-county family matters are heard at the South Dade Justice Center, which is in the town itself.
Criminal defense
Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the county agency that polices the town under contract.
Property insurance claims
A denied or underpaid claim on a Cutler Bay property, where a great deal of the housing was rebuilt after 1992 and a roof claim becomes an argument about what was done then.
07 How this works
The consultation, the documents, and what it costs
The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.
The Homestead office is at 100 NE 15th Street, Suite 210, a short drive south on US-1. It is the closest DAPENALAW office to Cutler Bay by a wide margin; the next one is in South Miami.
Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf: the same analysis a claim meets now, learned from the other side of the file.
09 The law behind this
- Fla. Stat. § 627.736 Personal Injury Protection
80% of medical expenses and 60% of lost wages up to $10,000, and the fourteen-day deadline for initial care.
- Fla. Stat. § 768.28 Claims against a town, a county or a transit agency
Written notice within three years, six months for the entity to respond, and recovery capped at $200,000 per person and $300,000 per incident.
- Fla. Stat. § 768.81 Comparative fault
More than 50% at fault and the claim recovers nothing, which is the whole argument in a pedestrian case.
- Fla. Stat. § 95.11 Deadlines
Two years to sue on most negligence claims accruing on or after March 24, 2023 — four years where the defendant is a government.

Questions
Who writes the crash report in Cutler Bay?
The Miami-Dade Sheriff’s Office. Cutler Bay has no police department of its own — the county polices the town under an interlocal agreement, and its South District Station is in the town. On US-1 and the Turnpike it may be the Florida Highway Patrol instead.
Is the courthouse really in Cutler Bay?
Yes. The South Dade Justice Center at 10710 Southwest 211th Street is in the town, and it is the branch that hears matters from the south of the county instead of sending them downtown to West Flagler Street.
Is there an office in Cutler Bay?
No. The office is at 100 NE 15th Street, Suite 210, in Homestead, a short drive south on US-1. It is the closest office to Cutler Bay; the next one is in South Miami.
A bus was involved. Does that change things?
Substantially. A transit vehicle means a public entity, which puts the claim under Fla. Stat. § 768.28: written notice within three years, six months for the entity to respond before suit, and recovery capped at $200,000 for one person and $300,000 for the incident. It starts with a notice, not a demand.
My crash was on the busway crossing.
That is a known pattern here. The South Dade TransitWay runs in its own lanes beside US-1 and crosses the surface streets at grade, so a driver turning across the road is looking for cars and a bus arrives in a lane that carries nothing else. What each driver could see of that lane is usually the whole question.
My matter is not a car accident. Do you take those too?
Yes — immigration, family law, criminal defense and property insurance claims are all handled from the Homestead office, each with its own page and its own fee terms. The free consultation is an injury term and does not apply to those.
How long do I have?
Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims. If a government or a transit agency is the defendant, four years to sue but written notice within three.
