Car accident lawyer in Goulds
A highway through the middle of a neighborhood, and three names for it
A crash in Goulds is a Miami-Dade County claim under the same Florida law as anywhere else: fourteen days to get initial care, the permanent injury threshold, two years to sue. What is local is the geometry. In most of south Miami-Dade, US-1 runs along an edge. In Goulds it runs through the middle, so a highway carrying Keys traffic and freight passes between the houses, the church and the school rather than beside them. And the corridor here goes by three names — US-1, South Dixie Highway and Old Dixie Highway — which are not all the same road and are not all held by the same government. If the road is part of your claim, getting that wrong means serving a notice on the wrong defendant. The statutes are on the Florida car accident page. What follows is about the road.
01 What a crash here actually looks like
A railroad siding that became a town, and then changed entirely
Goulds starts with a railroad. Homesteaders settled here in 1900, the Florida East Coast Railway built a siding in 1903 called Gould’s Siding after a railroad employee, and the name shortened. Packing houses went up along Old Dixie Highway; most were destroyed by a tornado in 1919 or the hurricane of 1926, and were rebuilt. In 1949 Mary Ann Ballard bought the former railway town of Cauley Square and restored it.
The community has changed more than almost anywhere in the county. In 2000, 76.83% of residents were non-Hispanic Black and 16.36% were Hispanic or Latino. By 2020 it was 38.84% and 54.05%. That is not turnover at the edges; it is a different community sharing the same streets, inside twenty years.
It grew while it changed. 7,453 residents in 2000, 10,103 in 2010, 11,446 in 2020 — but across 2.91 square miles of land, which makes it the least crowded of the communities around it at 3,934.7 people per square mile.
And it is a community of households with children and thin margins. 44.3% of its 3,547 households include a child under 18, the median age is 35.7, 12.6% of residents are 65 or over, and vacancy runs 6.7% overall with rental vacancy at 5.4%. In 2000 the median household income was $19,633 and 43.6% of residents were below the poverty line.
Three names for one corridor, and not one government behind them.
02 What nobody tells you
A notice served on the wrong government is a notice not served
US-1 here is State Road 5, and the state holds it. That matters only when the road itself is part of the claim — a signal, a sign, a shoulder, a drainage defect, a work zone. Then § 768.28 controls: written notice first, three years to give it and two on a wrongful death claim, six months for the agency to respond before any lawsuit, and caps of $200,000 per person and $300,000 per incident.
And against the state, the notice goes to two places. It has to be presented in writing to the agency and to the Florida Department of Financial Services both. The exception in the statute is for a municipality, a county and the Florida Space Authority — so a claim about a county street here needs no notice to the Department at all, while a claim about US-1 does. Same community, same week, two different procedures.
The names on this corridor do not tell you which is which. US-1, South Dixie Highway and Old Dixie Highway are not one road, and a highway shield on a sign is not a statement about who maintains a particular segment. Before a notice goes out, the authority for the exact point of the crash is confirmed against the agency rather than assumed from the street name on the report.
Goulds is unincorporated, so the Miami-Dade Sheriff’s Office works the crash, and the Florida Highway Patrol may work US-1. Whichever agency wrote it, the report is requested the same way, through the FLHSMV crash portal, and the people involved and their legal representatives can obtain it immediately rather than waiting out the 60-day confidentiality period under § 316.066(2).
Serious trauma leaves the community. Jackson South Medical Center on SW 152nd Street is the nearest trauma center and is Level II, a short run north; Homestead Hospital to the south is the nearest emergency department but is not a trauma center. A case here is filed in the Eleventh Judicial Circuit.
03 The roads
Where the claims actually come from
US-1, the Dixie Highway, straight through the middle: local traffic, Keys traffic and freight in the same lanes, through a residential community rather than around it.
The driveways and side streets meeting it, where a car leaving a neighborhood street has to cross or merge into highway-speed traffic — the single most common way a serious claim starts here.
Old Dixie Highway, the older alignment the packing houses were built along, still carrying local traffic beside the newer road and still sharing most of its name.
The pedestrian crossings of US-1, because the community exists on both sides of it. People cross a highway to reach ordinary things, and 44.3% of households here have a child in them.
The interior streets, county-held and comparatively empty at 3,935 people per square mile, where the collision is slower and the file depends on what was photographed before anything moved.
04 What to do now
The things that can only be done in the first two weeks
A checklist, not advice about your own case. None of it requires hiring anyone.
Get seen within fourteen days
Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. Homestead Hospital is the nearest emergency department; a serious injury goes north to Jackson South, and that transfer is part of the record.
Write down exactly which road, not just the name
US-1, South Dixie Highway and Old Dixie Highway are not interchangeable here. A cross street, a block number or the nearest business fixes the point, and that point decides the responding agency and the road authority.
Say at the scene if anything hurts
Under § 316.066(1)(a) any indication of a complaint of pain or discomfort is one of the things that obliges an officer to write a long-form report. Without it, a short form or an exchange-of-information slip may be all that exists.
Note whether a commercial vehicle was involved
A commercial vehicle also triggers a long-form report regardless of injury, and brings federal driving-hour and inspection records that an ordinary crash never produces. On a freight corridor that is worth establishing at the scene.
Ask the county for the report
Goulds is unincorporated, so the Miami-Dade Sheriff’s Office wrote it unless the Florida Highway Patrol worked US-1. Either way it is requested through the FLHSMV crash portal.
Pull your own declarations page
Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.
Do not give the other insurer a recorded statement
You are not required to. The answer given in the first week gets quoted back for the next two years.
05 The kinds of claim this covers
What a highway through a neighborhood produces
Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people and killing 272, according to the Florida Department of Highway Safety and Motor Vehicles, and the county’s Vision Zero program counts about 99 pedestrian deaths a year. No published count exists for Goulds alone. What US-1 running through the middle of a residential community produces is the local part.
Car accidents
The defining version here is the side street meeting the highway: a driver leaving a neighborhood has to join traffic moving at a speed the neighborhood never sees, and the gap judgment is the whole case.
Truck accidents
US-1 carries freight to and from the Keys and the agricultural south of the county, through here rather than around. A commercial vehicle triggers a long-form crash report under § 316.066(1)(a) regardless of injury, and brings federal driving and inspection records with it.
Pedestrian accidents
A community that lives on both sides of a highway crosses it. These cases turn on how fault is divided, and more than half the fault means recovering nothing at all, which is why where a person crossed and what the driver could see are established early.
Uninsured drivers
A through route brings drivers from everywhere carrying whatever their own budget required, and Florida requires no bodily injury liability coverage at all. Your own uninsured and underinsured motorist coverage is what fills that gap.
06 Also for Goulds
The other matters this office takes from here
Injury work is most of this practice. The rest run from the Homestead office, each with its own page and its own fee terms.
Property insurance claims
3,800 homes in a community that has been rebuilt after storms before — the packing houses here were destroyed in 1919 and again in 1926 — and where the modern argument is whether damage is wind, water or wear. Notice of the claim is due within one year of the date of loss.
Immigration
Removal defense, bond, asylum, family petitions and citizenship. Which court holds a case is decided by the file rather than by the address on it.
Family law
Divorce, time-sharing, support, property and protective orders in the Eleventh Judicial Circuit, in a community where 44.3% of households include a child under 18.
Criminal defense
Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the Sheriff rather than by a city department.
07 How this works
The consultation, the documents, and what it costs
The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.
The Homestead office is at 100 NE 15th Street, Suite 210, about eight miles south on the same corridor. There is parking on site.
Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf: the same analysis a claim meets now, learned from the other side of the file.
09 The law behind this
- Fla. Stat. § 768.28 Claims against a road authority
Written notice first — to the agency and, where the defendant is the state rather than a city or county, also to the Florida Department of Financial Services. Three years to give it, two on a wrongful death claim, six months for the agency to respond, and caps of $200,000 per person and $300,000 per incident.
- Fla. Stat. § 316.066 The crash report
A long-form report is required on death, injury, any indication of complaints of pain or discomfort, a towed vehicle or a commercial vehicle. Subsection (2) makes the report confidential for 60 days, but the people involved and their legal representatives may obtain it immediately.
- Fla. Stat. § 627.736 Personal Injury Protection
80% of medical expenses and 60% of lost wages up to $10,000, and the fourteen-day deadline for initial care.
- Fla. Stat. § 768.81 Fault
Damages are reduced by your share of the fault, and more than 50% of the fault bars recovery entirely.
- Fla. Stat. § 95.11 Deadlines
Two years to sue on most negligence claims accruing on or after March 24, 2023, and two years on a wrongful death claim.

Questions
A defect in the road caused my crash. Who is the defendant?
It depends which road, and here that is a real question rather than a formality. US-1 is a state road, which puts the claim under § 768.28 with written notice to the agency and to the Florida Department of Financial Services both. A county street needs no notice to the Department. Because US-1, South Dixie Highway and Old Dixie Highway are not one road, the authority for the exact point is confirmed with the agency before anything is served.
What happens if the notice goes to the wrong agency?
A claim against a government under § 768.28 cannot be filed until the written notice has been presented and the agency has had six months to respond. A notice served on the wrong government does not start that clock, and the deadline keeps running in the meantime. That is why the road authority is established early rather than at the end.
Who writes the crash report in Goulds?
The Miami-Dade Sheriff’s Office, because Goulds is unincorporated. On US-1, a state road, the Florida Highway Patrol may work it instead. Whichever agency wrote it, the report is requested through the FLHSMV crash portal, and under § 316.066(2) the people involved and their legal representatives can obtain it immediately rather than waiting out the 60-day confidentiality period.
A truck was involved. Does that change anything?
Yes, in two ways. A commercial vehicle obliges an officer to write a long-form crash report under § 316.066(1)(a) whether or not anyone was hurt. And a commercial carrier keeps federal records — driving hours, inspections, maintenance — that an ordinary driver does not, which are preserved by a written request rather than by waiting.
Which hospital would I be taken to?
Jackson South Medical Center on SW 152nd Street is the nearest trauma center and is Level II, a short run north. Homestead Hospital to the south is the nearest emergency department but is not a trauma center. The county’s two Level I centers, Ryder at Jackson Memorial and HCA Florida Kendall, are further north again, and a child is normally taken to Nicklaus Children’s.
Is there an office in Goulds?
No. The Homestead office is at 100 NE 15th Street, Suite 210, about eight miles south on the same corridor, and it serves all of south Miami-Dade.
Where would my case be heard?
In the Eleventh Judicial Circuit, which covers all of Miami-Dade County. Most injury claims are resolved without a lawsuit.
How long do I have?
Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims, wrongful death included. If a road authority is the defendant there is a separate clock in front of that one: written notice within three years, or within two on a wrongful death claim, and on US-1 that notice goes to the Florida Department of Financial Services as well as to the agency.
