Car accident lawyer in Plant City
One of only three cities in the county, and a county line a few miles east
A crash in Plant City is a Hillsborough County claim, and the law that decides it is the same law as anywhere in Florida: the fourteen-day deadline for initial care, the injury threshold, two years to sue. Two things here are not like the rest of the county. Plant City is an actual city with its own police department, which is unusual in Hillsborough — there are only three — so the report comes from the city and not from the Sheriff. And the Polk County line is a few miles east, which means a crash on the other side of it is a different judicial circuit, a different clerk and a different courthouse. The statutes are set out on the Florida car accident page. What follows is about the two lines that run near here.
01 What a Plant City crash actually looks like
An interstate, an agricultural road network, and a small downtown grid
Interstate 4 runs along the northern side, carrying freight and commuter traffic between Tampa and Orlando. It is the fastest road anywhere near here and the one that produces the worst injuries, and its interchanges put highway-speed traffic onto local roads in a short distance.
State Road 574, Baker Street and Alexander Street carry the local traffic through the city, past the schools and into the downtown grid, where the collisions are the ordinary turning and stop-sign ones at moderate speed.
The agricultural road network runs in every direction outside the city limits, and it carries farm equipment, loaded trailers and workers’ vehicles on two-lane roads with no lighting and very little shoulder. The speed differential between a tractor and a car at fifty-five is the hazard, and it is highest in exactly the places drivers do not expect it.
Serious trauma leaves Plant City entirely. Tampa General is the only Level I trauma center in Hillsborough County, so anyone badly hurt here is taken more than twenty miles west, and the medical record ends up split between a local emergency department and a Tampa hospital.
Three cities in the whole county. This is one of them, and that changes who holds the report.
02 The part nobody tells you about Plant City
A real city here, and a different judicial circuit a few miles east
Plant City had 39,764 residents at the 2020 Census and covers about 31 square miles. It is one of only three incorporated cities in Hillsborough County, with Tampa and Temple Terrace, and it runs its own police department.
That is the opposite of the situation almost everywhere else in this county. The Hillsborough County Sheriff’s Office says it plainly: an incident inside the city limits of Tampa, Temple Terrace or Plant City is not unincorporated county, and residents should call the city’s own department. So a Plant City crash produces a Plant City Police Department report, not a Sheriff’s one — unless it happened on Interstate 4 or a state road, where the Florida Highway Patrol works it.
The county line east of the city is the other thing worth knowing. Hillsborough is in the Thirteenth Judicial Circuit. Polk County, which begins a few miles east, is in the Tenth Judicial Circuit along with Hardee and Highlands. A crash on the far side of that line is a Polk case: a different sheriff, a different clerk, and a courthouse in Bartow rather than in Tampa.
On a road like Interstate 4 that is easy to get wrong, because the drive is continuous and the line is not marked in any way a driver notices. Which side of it the crash happened on decides where any lawsuit would be filed.
And because there is a city here, there is a city to claim against. A claim involving a city vehicle or a dangerous condition on a city street runs under Fla. Stat. § 768.28: written notice to the city within three years, six months for it to respond before suit, caps of $200,000 per person and $300,000 per incident, and four years to file rather than two.
03 The roads
Where the claims actually come from
Interstate 4, along the north, the fastest road in the area and the one that produces the most serious injuries.
State Road 574 and Alexander Street, the main local routes through the city and its downtown grid.
State Road 39 and the county roads north and south, carrying agricultural traffic between fields, packing houses and the interstate.
Baker Street and the downtown grid, where the collisions are low-speed, frequent and usually about a stop sign.
The unlit two-lane roads outside the city limits, where farm equipment shares the road with traffic doing fifty-five.
04 What to do now
The things that can only be done in the first two weeks
A checklist rather than advice about a particular case. The county question belongs at the top of it.
Get seen within fourteen days
Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. It is the deadline that expires before most people have decided what to do.
Work out which county you were in
Polk County begins a few miles east and sits in a different judicial circuit. On Interstate 4 the line is not obvious from the car. The nearest mile marker or exit number settles it, and it decides where a lawsuit would be filed.
Ask the city, not the Sheriff
Inside the city limits the report is the Plant City Police Department’s. Outside them it is the Hillsborough County Sheriff’s Office, and on Interstate 4 and the state roads it is the Florida Highway Patrol. Record which one and the report number.
Note any farm or commercial vehicle
A tractor, a loaded trailer, a packing-house truck. That puts a business behind the driver, with records that exist for a defined period and are then lawfully destroyed.
Photograph the lighting if it was dark
On the two-lane roads outside the city there is no ambient light at all, and what each driver could see is usually the whole argument. It cannot be reconstructed later.
Pull your own declarations page
Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.
Do not give the other insurer a recorded statement
You are not required to. The answer given in the first week gets quoted back for the next two years.
05 The kinds of crash this covers
The same roads, five different claims
Hillsborough County recorded 26,269 traffic crashes in 2024, with 17,359 people injured and 180 killed, according to the Florida Department of Highway Safety and Motor Vehicles. That is a county figure: there is no published count for Plant City alone, and anyone quoting one is estimating. Which of them an interstate and an agricultural road network produce between them is the local part.
Car accidents
The bulk of it, split between low-speed collisions in the downtown grid and much more serious ones on Interstate 4 and the rural roads.
The fourteen-day deadline applies to every one of them, whoever was at fault.
Truck accidents
Interstate 4 is a freight corridor between Tampa and Orlando, and agricultural haulage moves on the local roads around the clock in season.
It is also a different case: a company behind the driver, a USDOT number, and records kept for a defined period and then lawfully destroyed.
Workplace accidents
Field, packing-house and warehouse work produces injuries on someone else’s premises and with someone else’s equipment, including people hurt in or around a work vehicle.
This office does not take workers’ compensation cases. It takes third-party injury claims — against a negligent contractor, a property owner or an equipment maker — which can run alongside a compensation claim rather than instead of it. The right to bring an injury claim in Florida does not depend on immigration status, and status is not an element of the case.
Uninsured drivers
Florida requires no driver to carry bodily injury liability coverage at all, so the underinsured case — limits smaller than the harm done — is the common one rather than the exception.
The claim moves to your own policy, which makes the declarations page the most important document in the file.
Pedestrian accidents
The downtown grid has sidewalks and the roads outside it do not, so anyone walking out there is walking in the lane, usually in the dark.
These turn on how fault is divided, and more than half the fault means recovering nothing at all.
06 Also for Plant City
The other matters this office takes from here
Injury work is most of this practice. The rest run from the Tampa office, each with its own page and its own fee terms.
Immigration
Removal defense, bond, asylum, family petitions and citizenship — questions that follow the agricultural workforce here through every season.
Family law
Divorce, time-sharing, support, property and protective orders in the Thirteenth Judicial Circuit. A family across the Polk line is a Tenth Circuit matter instead, filed in Bartow.
Criminal defense
Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the city’s own police department rather than by the Sheriff.
Property insurance claims
A denied or underpaid claim on a Plant City home, farm building or business, where agricultural structures are argued about on different terms from a residential roof.
07 How this works
The consultation, the documents, and what it costs
The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone — which from this end of the county is usually the sensible way to start.
The Tampa office is at 4231 N Habana Avenue, west of downtown Tampa and a straight run in along Interstate 4. It is the office that serves all of Hillsborough County.
Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.
08 Who you deal with
Jose A. Dapena
Admitted to The Florida Bar in 1998, number 152358, and admitted to the United States District Courts for the Southern, Middle and Northern Districts of Florida — the Middle District is the federal court that covers both Hillsborough and Polk.
Before representing injured people he was in-house counsel for a Personal Injury Protection carrier, reviewing claims on the insurer’s behalf: the same analysis a claim meets now, learned from the other side of the file.
09 The law behind this
- Fla. Stat. § 627.736 Personal Injury Protection
80% of medical expenses and 60% of lost wages up to $10,000, and the fourteen-day deadline for initial care.
- Fla. Stat. § 768.28 Claims against a city, a county or the state
Written notice first, and three years to give it — to the agency, and also to the Florida Department of Financial Services where the defendant is the state rather than the county. Six months for the agency to respond, and caps of $200,000 per person and $300,000 per incident.
- Fla. Stat. § 768.81 Comparative fault
More than 50% at fault and the claim recovers nothing, which is the whole argument in a pedestrian case.
- Fla. Stat. § 95.11 Deadlines
Two years to sue on most negligence claims accruing on or after March 24, 2023 — four years where the defendant is a government.

Questions
Who writes the crash report in Plant City?
The Plant City Police Department, for anything inside the city limits. Plant City is one of only three incorporated cities in Hillsborough County, and the Sheriff’s Office says itself that incidents inside those city limits are not unincorporated county. Outside the limits it is the Sheriff, and on Interstate 4 and the state roads it is the Florida Highway Patrol.
My crash was on I-4 east of town. Which county was that?
It may well have been Polk. The line is a few miles east of the city and nothing on the road marks it in a way a driver notices. Polk is in the Tenth Judicial Circuit with Hardee and Highlands, not the Thirteenth, so a lawsuit would be filed in Bartow rather than Tampa. The nearest mile marker or exit number usually settles it.
Is there an office in Plant City?
No. The office is at 4231 N Habana Avenue in Tampa, a straight run in along Interstate 4. It is the office that serves all of Hillsborough County, and a first conversation can happen by phone.
A tractor or a farm truck was involved.
That usually brings a business behind the driver, with different insurance and with records — maintenance, dispatch, driver files — that exist for a defined period and are then lawfully destroyed. The request to preserve them has to go out early.
I was hurt working in a field or a packing house. Can you help?
This office does not take workers’ compensation cases. It does take third-party injury claims — against a negligent contractor, a property owner or an equipment manufacturer — and those can run alongside a compensation claim. The right to bring an injury claim in Florida does not depend on immigration status, and status is not an element of the case.
Where would I be taken if it was serious?
Tampa General, more than twenty miles west, because it is the only Level I trauma center in Hillsborough County. That usually means a local emergency department record and a Tampa hospital record for the same crash.
How long do I have?
Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims. If a city, the county or the state is the defendant, four years to sue but written notice within three.
