- A worker on a Brickell construction site is hurt by another trade’s crew and is told workers’ compensation is the only claim available.
- A passenger is injured in a crash on the way back from the Port of Miami and discovers the at-fault driver carries no bodily injury coverage at all.

- A roof is damaged in a named storm and the carrier denies it as wear and tear without addressing the date of loss.
Questions about our Miami personal injury office
Which courthouse will my Miami-Dade case be filed in?
Civil injury claims from across Miami-Dade are filed at the Circuit Court at 73 West Flagler Street in downtown Miami.
Cases arising in the far south of the county may instead be heard at the South Dade Justice Center in Cutler Bay, which is the closer venue for Homestead, Florida City and the Redland.
Do I have to come to the office in South Miami?
Not necessarily. A first conversation happens by phone or video, and documents are handled electronically.
The office is there when meeting in person is better — and for people in the south of the county, the Homestead office on Krome Avenue is usually the shorter drive.
My accident happened in Hialeah, Doral or Kendall. Is that still this office?
Yes. The office serves the whole of Miami-Dade, and the case is filed in the county regardless of which municipality the crash happened in.
The municipality matters for one thing: which police agency wrote the report, and therefore where it has to be requested from.
I do not speak English. Who will I be dealing with?
Jose Dapena himself. He was born in Puerto Rico and speaks Spanish, and so does the staff — so the whole matter runs in Spanish, from the first call to the last, without anything being relayed through an interpreter.
