Car accident lawyer in Sweetwater

Four square miles, its own police department, and three road authorities

A crash in Sweetwater is a Miami-Dade County claim under the same Florida law as anywhere else: fourteen days to get initial care, the injury threshold, two years to sue. What is local is that Sweetwater is a city. It has been incorporated since October 10, 1941, it has 19,363 residents at the 2020 census, and it has its own police department — which makes it the exception in a part of the county where almost everything is unincorporated and the Sheriff writes the report. Three different kinds of road box in roughly four square miles, so where the crash happened decides which agency responded and which body holds the road. What follows is about that.

01 What a crash here actually looks like

A small city with a turnpike, an expressway and US-41 around it

The Homestead Extension of Florida’s Turnpike forms the western edge, a limited-access state toll road operated by Florida’s Turnpike Enterprise, where the Florida Highway Patrol normally works the crash.

The Dolphin Expressway, State Road 836, crosses the middle — a tolled county expressway carrying traffic between downtown Miami, the airport and the western suburbs, with ramps that put highway speeds onto city streets within a block.

SW 8th Street, US-41, runs along the southern border, separating the city from the Florida International University campus on the other side. Thousands of students live on the Sweetwater side and cross to the campus side.

Between all of that sits a city of about four square miles. It grew 43% in a decade, from 13,499 residents in 2010 to 19,363 in 2020, partly by annexation — Dolphin Mall was voted into the city in December 2010, and roughly two more square miles were added in 2021. A mall, a television headquarters and several university campuses now generate traffic inside a town that had 645 people in 1960.

02 What nobody tells you

Crossing SW 8th Street is the thing this city is known for

It is the city’s southern border and a federal highway at the same time. In August 2017 a university student was killed crossing it. A pedestrian bridge was then under construction to carry people over it between the campus and Sweetwater, and on March 15, 2018 a span of that bridge fell onto SW 8th Street at SW 109th Avenue while traffic was stopped at a red light, killing six people. Whatever else that history means, it is the reason crossing this particular road on foot is the live question here and not an abstract one.

Sweetwater has its own police department, which is genuinely unusual in western Miami-Dade. A crash inside the city limits is a Sweetwater Police Department report. Cross the line into Westchester, Fontainebleau or Tamiami and it belongs to the Miami-Dade Sheriff’s Office; get on the Turnpike extension or the Dolphin and it is normally the Florida Highway Patrol. Four possibilities inside a few minutes’ driving.

Who holds the road decides who can be sued over it. A claim about the road itself — a signal, a sight line, the surface — runs against a government defendant under § 768.28, which begins with written notice and caps damages at $200,000 per person and $300,000 per incident. The state holds US-41, Florida’s Turnpike Enterprise holds the turnpike extension, the county expressway authority holds the Dolphin, and the city holds its own streets.

HCA Florida Kendall is the Level I trauma center for this side of the county, with Ryder at Jackson Memorial the other one. A child is normally taken to Nicklaus Children’s rather than to an adult trauma center.

A Sweetwater case is filed in the Eleventh Judicial Circuit. Most injury claims are resolved with the insurer before any lawsuit is filed.

03 The roads

Where the claims actually come from

SW 8th Street, US-41, the southern border: six lanes of state highway with a university on one side and the people who live on the other side needing to cross it.

The Dolphin Expressway, SR 836, through the middle, where the ramps deliver expressway speeds into city traffic and the merge is where the serious ones happen.

The Homestead Extension of Florida’s Turnpike, the western edge, a limited-access toll road where the Highway Patrol writes the report and a disabled vehicle is the most dangerous thing on the road.

SW 107th and SW 109th Avenues, the north-south city streets that carry everything between those three, including every student crossing toward the campus.

The mall and shopping center lots, where a crash is not a highway matter at all: often no police report, fault argued without one, and the property owner’s own conduct potentially part of the claim.

04 What to do now

The things that can only be done in the first two weeks

This is a checklist. It is not advice about your own case, and none of it requires hiring anyone.

  1. Get seen within fourteen days

Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. HCA Florida Kendall is the trauma center for this side of the county, and there are urgent care clinics along SW 8th Street.

  2. Confirm it was Sweetwater Police

Inside the city limits it is the Sweetwater Police Department. Outside them it is the Sheriff, and on the Turnpike extension or the Dolphin it is normally the Highway Patrol. A small city means the line is close, so note the agency and the report number rather than assuming.

  3. Fix the location to a cross street

On SW 8th Street a few hundred feet decides whether the crash was in Sweetwater, in unincorporated county, or on a ramp. That determines the agency, the records and, in a road claim, the defendant.

  4. Photograph the crossing and the signal

On US-41 the question is almost always how long a person had to cross and what a driver could see. Signal timing, a worn crosswalk, a blocked sight line — all evidence, and all of it can be changed within weeks.

  5. Pull your own declarations page

Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.

  6. Do not give the other insurer a recorded statement

You are not required to. The answer given in the first week gets quoted back for the next two years.

05 The kinds of crash this covers

A highway border, an expressway through the middle, four claims

Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people and killing 272, according to the Florida Department of Highway Safety and Motor Vehicles, and the county’s Vision Zero program counts about 99 pedestrian deaths a year. No published count exists for Sweetwater alone. What a small city wrapped in highways produces is the local part.

Car accidents

The bulk of it, and here it is the transition: an expressway ramp feeding a city street, or a turn across six lanes of US-41, where the speed on one side of the signal has nothing to do with the speed on the other.

Pedestrian accidents

People live on one side of SW 8th Street and study on the other, and the road between them is a federal highway. These cases turn on how fault is divided, and more than half the fault means recovering nothing at all.

Rideshare accidents

A university, a mall and a nightlife corridor on an expressway produce a lot of trips. Whether the driver’s app was on, and which phase of the trip they were in, decides which policy covers the crash — and that is established from records held by the company rather than by the driver.

Hit-and-run

On a through highway with expressway ramps a block away, the driver who leaves often does so successfully. When there is no other insurer, the claim becomes an uninsured motorist claim on your own policy, which requires prompt written notice.

The other matters this office takes from here

Injury work is most of this practice. The rest run from the South Miami office, each with its own page and its own fee terms.

Immigration

Removal defense, bond, asylum, family petitions and citizenship. In a city whose largest reported ancestries are Cuban and Nicaraguan, these are family matters as often as they are legal ones, and the court that holds a case is decided by the file rather than by the address on it.

Criminal defense

Bond and release conditions, DUI, drug charges and theft. Inside the city the arrest is Sweetwater Police rather than the Sheriff, but the first appearance and the case are still in the Eleventh Judicial Circuit.

Property insurance claims

A city of condominiums and apartment buildings produces the claim nobody expects: the line between what the association’s policy covers and what the unit owner’s covers, argued after a roof or a supply line has already failed. Notice of the claim is due within one year of the date of loss.

Family law

Divorce, time-sharing, support, property and protective orders in the Eleventh Judicial Circuit.

07 How this works

The consultation, the documents, and what it costs

The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.

The Miami office is at 5975 Sunset Drive, Suite 102, in South Miami, east and south of here. There is parking on site.

Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

09 The law behind this

Questions

Who writes the crash report in Sweetwater?

The Sweetwater Police Department, because Sweetwater is an incorporated city with its own department — which makes it the exception out here. Outside the city limits it is the Miami-Dade Sheriff’s Office, and on the Turnpike extension or the Dolphin Expressway it is normally the Florida Highway Patrol. The city is small enough that a few hundred feet can change the answer.

Why does it matter which agency responded?

It does not change your rights at all. It changes where the report lives and who you ask for it, and it is the first thing an insurer checks. Whichever agency wrote it, the report can be requested through the FLHSMV crash portal.

Which hospital would I be taken to?

HCA Florida Kendall is the Level I trauma center for the west and south of Miami-Dade; the county’s other Level I center is Ryder Trauma Center at Jackson Memorial. A child is normally taken to Nicklaus Children’s rather than to an adult trauma center.

It happened on the FIU side of SW 8th Street. Is that different?

Possibly, yes. Florida International University is a state institution, so a claim arising on the campus runs against a government defendant under § 768.28 — written notice first, to the university and to the Florida Department of Financial Services both, and caps of $200,000 per person and $300,000 per incident. SW 8th Street itself is US-41, a state road, which is a different defendant again and the same two notices. Which side of the curb it happened on is worth being precise about.

My crash was in the Dolphin Mall parking lot.

That is a different kind of claim. There is frequently no police report on private property, so fault is established from video, witnesses and the damage itself rather than from an officer’s findings. The property owner’s own conduct — lighting, layout, security, maintenance — can also be part of it.

Is there an office in Sweetwater?

No. The office is at 5975 Sunset Drive, Suite 102, in South Miami, and it serves all of Miami-Dade.

How long do I have?

Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims. If a government body is the defendant — the city, the county, the state or a university — four years to sue but written notice within three.
