Car accident lawyer in Leisure City

The address says Homestead. The jurisdiction does not.

A crash in Leisure City is a Miami-Dade County claim under the same Florida law as anywhere else: fourteen days to get initial care, the permanent injury threshold, two years to sue. What is local is a confusion that costs people weeks. Leisure City is unincorporated, but its mail carries a Homestead address and the 33033 ZIP code, so people call the Homestead Police Department for a report that the Miami-Dade Sheriff’s Office wrote — or never think to ask the county at all. On top of that, two different state road authorities hold the two edges of the community while the county holds everything in between. Who the defendant is, and who to ask for the report, are both decided by geography rather than by what is printed on an envelope. The statutes are on the Florida car accident page. What follows is about getting that right.

01 What a crash here actually looks like

A growing community between a highway and a turnpike

Leisure City is growing while most of this county is not. 22,152 residents in 2000, 22,655 in 2010, and 26,324 in 2020 — up 16.2% in a decade, in 8,054 housing units with 3.4% vacant and a homeowner vacancy rate of 1.1%.

It is young, and it is full of children. The median age is 35.2 against 47.0 in the oldest communities of this county, 26.1% of residents are under 18, and 43.5% of its 7,782 households include a child under 18. Only 12.4% of residents are 65 or older.

It is Hispanic, and it is not only Hispanic. 78.90% of residents are Hispanic or Latino and 13.07% are non-Hispanic Black, against 65.30% and 18.00% in 2000. A place that added nearly four thousand people in a decade while its composition shifted is not a settled grid, and the household at a given address this year may not be the one that was there five years ago — which matters when a witness has to be found.

And it sits between two highways it does not control. US-1 runs along the northwest edge, the Homestead Extension of Florida’s Turnpike along the southeast, with Exit 2 at SW 157th Avenue and Exit 5 at SW 288th Street. Homestead is to the south and east, Naranja to the north, Redland to the northwest. The older community of Modello sits in the northwest corner, and Coral Castle — whose own mailing address reads Homestead though the land is unincorporated county — sits on South Dixie Highway at the edge.

What is printed on an envelope is not a jurisdiction.

02 What nobody tells you

Three agencies, two of them states, and none of them Homestead

Leisure City has no police department, because it is not a city. It is an unincorporated census-designated place, so the Miami-Dade Sheriff’s Office patrols it and writes the crash reports. The City of Homestead Police Department has no jurisdiction here, however your address is written. People lose weeks asking the wrong agency for a report that was never theirs.

On the two highways it may be the Florida Highway Patrol instead. US-1 is a state road and the Turnpike is a limited-access state facility, and the Highway Patrol commonly works both. Whichever agency wrote the report, it is requested the same way, through the FLHSMV crash portal.

If the road itself is part of the claim, you have to know which road. US-1 is held by the Florida Department of Transportation. The Homestead Extension is operated by Florida’s Turnpike Enterprise. Both are the state, so § 768.28 requires written notice to the agency and to the Florida Department of Financial Services both, three years to give it and two on a wrongful death claim, with caps of $200,000 per person and $300,000 per incident. The interior streets belong to Miami-Dade County, and a claim against a county needs no notice to the Department at all.

The road names on this corridor do not settle it. US-1, South Dixie Highway and Old Dixie Highway are not all one road, and the shield on a sign is not a statement about who holds a particular segment. Before a notice goes out, the agency for the exact point of the crash is confirmed rather than assumed, because a notice served on the wrong government is a notice not served.

Serious trauma does not stay local. Homestead Hospital is the nearest emergency department and it is not a trauma center. Jackson South Medical Center on SW 152nd Street is the nearest trauma center and is Level II; the county’s two Level I centers, Ryder at Jackson Memorial and HCA Florida Kendall, are further north again. A case here is filed in the Eleventh Judicial Circuit.

03 The roads

Where the claims actually come from

US-1, South Dixie Highway, along the northwest: the road everything in south Miami-Dade is organized around, carrying local traffic, Keys traffic and freight in the same lanes, with commercial driveways between the signals.

The Homestead Extension of Florida’s Turnpike, along the southeast: limited access and highway speeds, with Exit 2 at SW 157th Avenue and Exit 5 at SW 288th Street as the only ways on and off.

The turnpike ramps themselves, where a driver leaving 70 miles an hour meets a county street with a traffic signal on it, which is a different kind of collision from anything that happens inside the community.

The school approaches, in a community where 43.5% of households have a child under 18 and Leisure City K-8 sits among the houses, so arrival and dismissal put children on residential streets twice a day.

The interior grid, county streets where the crash is slower, the damage looks lighter, and the file ends up depending on what was photographed before the cars moved.

04 What to do now

The things that can only be done in the first two weeks

A checklist, not advice about your own case. None of it requires hiring anyone.

  1. Get seen within fourteen days

Personal Injury Protection pays nothing at all if the first treatment falls outside fourteen days — not a reduced amount, nothing. Homestead Hospital is the nearest emergency department; a serious injury goes north to a trauma center, and that transfer is part of the record.

  2. Ask the county, not the city

Leisure City is unincorporated. The Miami-Dade Sheriff’s Office wrote the report unless it happened on US-1 or the Turnpike, where the Florida Highway Patrol may have. Homestead Police did not, whatever your address says.

  3. Fix which road you were on

US-1, the Turnpike, a ramp, or a county street. That single fact decides the responding agency, the road authority, and whether a government notice has to go to the Florida Department of Financial Services as well as to the agency.

  4. Photograph before anything moves

Position, resting place, damage to both vehicles, and the whole intersection from four directions. On an interior street there is no traffic camera, so your phone is the record.

  5. Get names at the scene

The other driver’s license, plate, insurer and policy number, and the names of anyone standing there. If the crash did not require a long-form report, there is no witness list and the neighbor who saw it is unfindable in two weeks.

  6. Pull your own declarations page

Uninsured and underinsured motorist coverage, and whether it stacks. Florida does not require any driver to carry bodily injury liability, so your own policy is often the ceiling.

  7. Do not give the other insurer a recorded statement

You are not required to. The answer given in the first week gets quoted back for the next two years.

05 The kinds of claim this covers

A community between two highways, four claims

Miami-Dade County recorded 60,000 traffic crashes in 2024, injuring 29,359 people and killing 272, according to the Florida Department of Highway Safety and Motor Vehicles, and the county’s Vision Zero program counts about 99 pedestrian deaths a year. No published count exists for Leisure City alone. What a young, growing community wedged between US-1 and the Turnpike produces is the local part.

Car accidents

Two populations of crash. On the interior grid it is slow and the paperwork is thin. On US-1 and at the turnpike ramps it is fast, and that is where the injuries are.

Truck accidents

Both edges of this community are freight routes — a US highway on one side and a turnpike on the other — so a truck leaving either one is on county streets within a block. A commercial vehicle triggers a long-form crash report under § 316.066(1)(a) regardless of injury, and it brings federal driving and inspection records that an ordinary crash does not.

Pedestrian accidents

26.1% of residents are under 18 and the schools sit among the houses, so the exposure here is children on residential streets at fixed hours. These cases turn on how fault is divided, and more than half the fault means recovering nothing at all.

Uninsured drivers

Florida requires no bodily injury liability coverage at all, so the at-fault driver may have nothing behind them beyond property damage and PIP. Your own uninsured and underinsured motorist coverage is what fills that gap.

06 Also for Leisure City

The other matters this office takes from here

Injury work is most of this practice. The rest run from the Homestead office, each with its own page and its own fee terms.

Immigration

Removal defense, bond, asylum, family petitions and citizenship. Which court holds a case is decided by the file rather than by the address on it, so an unincorporated address changes nothing about where a case is heard.

Property insurance claims

8,054 homes in the part of the county that takes a hurricane first, where the fight is usually whether the damage is wind, water or wear. Notice of the claim is due within one year of the date of loss.

Family law

Divorce, time-sharing, support, property and protective orders in the Eleventh Judicial Circuit. In a community where 43.5% of households have a child under 18, time-sharing is most of it.

Criminal defense

Bond and release conditions, DUI, drug charges, theft and domestic violence, after an arrest by the Sheriff rather than by a city department.

07 How this works

The consultation, the documents, and what it costs

The first conversation is with Jose A. Dapena, not with an intake department. On an injury matter it is free and commits you to nothing, and it can happen by phone.

The Homestead office is at 100 NE 15th Street, Suite 210, a few minutes south in Homestead. There is parking on site.

Fees differ by practice and are stated before anything is signed. Injury work is contingent, normally payable only if there is a recovery, with costs governed by the written agreement. Family and immigration are hourly, with payment plans and separate government filing fees. Criminal is a flat fee set by the charges and the scope, with no payment plans. The free consultation is an injury term and does not travel to the others.

09 The law behind this

  • Fla. Stat. § 627.736 Personal Injury Protection

80% of medical expenses and 60% of lost wages up to $10,000, and the fourteen-day deadline for initial care.

  • Fla. Stat. § 768.28 Claims against a road authority

Written notice first — to the agency and, where the defendant is the state or Florida’s Turnpike Enterprise rather than a city or county, also to the Florida Department of Financial Services. Three years to give it, two on a wrongful death claim, and caps of $200,000 per person and $300,000 per incident.

  • Fla. Stat. § 316.066 When a crash report gets written

A long-form report is required on death, injury, any indication of complaints of pain or discomfort, a towed vehicle or a commercial vehicle. Otherwise a short form or an exchange-of-information form is enough, and a driver has 10 days to file their own written report.

  • Fla. Stat. § 768.81 Fault

Damages are reduced by your share of the fault, and more than 50% of the fault bars recovery entirely.

  • Fla. Stat. § 95.11 Deadlines

Two years to sue on most negligence claims accruing on or after March 24, 2023, and two years on a wrongful death claim.

Questions

My address says Homestead. Why is this not a Homestead case?

Because a mailing address is a postal convenience, not a jurisdiction. Leisure City is unincorporated Miami-Dade and carries a Homestead address with the 33033 ZIP code, but the City of Homestead’s police have no authority here. The Miami-Dade Sheriff’s Office patrols it and writes the reports. Coral Castle is the clearest example: its own mailing address reads Homestead while the land it sits on is unincorporated county.

Who do I ask for the crash report?

The Miami-Dade Sheriff’s Office for anything on the interior streets. On US-1 or the Turnpike the Florida Highway Patrol may have worked it instead. Whichever agency wrote it, the report is requested through the FLHSMV crash portal, and the people involved and their legal representatives can obtain it immediately rather than waiting out the 60-day confidentiality period.

A pothole or a missing sign caused it. Who is the defendant?

It depends which road. US-1 belongs to the Florida Department of Transportation and the Homestead Extension to Florida’s Turnpike Enterprise — both are the state, so § 768.28 requires written notice to the agency and to the Florida Department of Financial Services. The interior streets are county, and a county claim needs no notice to the Department. The names on this corridor do not settle it, so the agency for the exact point is confirmed before a notice goes out.

It happened on a turnpike ramp. Is that different?

For the report, usually yes — the Florida Highway Patrol commonly works the Turnpike. For a claim against the road itself, the operator is Florida’s Turnpike Enterprise, which is a state agency, so the notice goes to the Department of Financial Services as well. For a claim against the other driver, it is an ordinary negligence claim at highway speed, which generally means a more serious injury and a more serious fight about it.

Which hospital would I be taken to?

Homestead Hospital is the nearest emergency department, but it is not a trauma center. Serious trauma goes north — Jackson South Medical Center on SW 152nd Street is the nearest, a Level II center, and the county’s two Level I centers, Ryder at Jackson Memorial and HCA Florida Kendall, are further still. A child is normally taken to Nicklaus Children’s.

Is there an office in Leisure City?

No, but the Homestead office at 100 NE 15th Street, Suite 210, is a few minutes south, and it serves all of south Miami-Dade.

Where would my case be heard?

In the Eleventh Judicial Circuit, which covers all of Miami-Dade County. Most injury claims are resolved without a lawsuit.

How long do I have?

Fourteen days to get initial care for Personal Injury Protection to pay anything, and two years to sue on most negligence claims, wrongful death included. If a road authority is the defendant there is a separate clock: written notice within three years, or within two on a wrongful death claim, and where the defendant is the state or the Turnpike that notice goes to the Florida Department of Financial Services as well as to the agency.
