Homestead hit and run lawyer

Why your own policy is the document that decides this, not the police report

When the other driver leaves a crash in Homestead, Florida City or the Redland, two things still pay and neither one requires that driver to be identified. Personal Injury Protection pays regardless of fault, and the fourteen-day treatment deadline in Fla. Stat. § 627.736 applies exactly as it would otherwise. Above PIP, the claim runs against your own uninsured motorist coverage — and whether a driver who fled counts as uninsured comes from your policy’s own definition rather than from the statute, which never mentions hit-and-run at all. That makes the declarations page and the policy the first documents to find, ahead of the crash report. South Dade is also where a fleeing driver has the best chance of not being found: unlit two-lane roads, almost no cameras, and a Turnpike entrance and a highway to the Keys minutes away. The coverage analysis is explained in full on the Florida hit and run page. What follows is the South Dade part.

Quick answers about Homestead hit and run claims

The driver is gone. Is there anything to claim?
Usually yes, and from two places. PIP pays without regard to fault, and above it the claim is against your own uninsured motorist coverage. Neither requires the other driver to be identified.
Does § 627.727 cover hit-and-run?
The statute never uses the phrase. It requires UM coverage unless it was rejected in writing on an approved form, and whether an unidentified fleeing driver is covered comes from your own policy’s definition — which is why the policy is the document to read.
Do I still have a PIP deadline?
Yes, and it is the one that runs out first. Treatment has to begin within fourteen days of the crash under § 627.736, whoever caused it and whether or not they were found.
Do I have to report it?
Yes. Section 316.065(1) requires immediate notice to law enforcement for any crash involving injury or at least $2,000 in property damage. A UM claim will also require prompt notice under the policy itself.
How long do I have?
Two years for a negligence claim against the driver if they are identified. A UM claim is an action on a written contract, which § 95.11(2)(b) gives five years — but the policy may require notice far sooner, so the contract sets the real calendar.
Why are these so common out here?
Long unlit two-lane roads, few cameras, few nearby witnesses, and the Turnpike and US-1 south within minutes of most of the area. A vehicle can be out of the county before anybody reports it.
What if they find the driver later?
Then the negligence claim against them revives, and the UM claim typically becomes an underinsured one to the extent their limits fall short. Both tracks are kept open rather than one being abandoned.

01 The law, once

Which Florida laws apply to a Homestead hit and run claim

The rules are the same across Florida, so they are written out in full on one page rather than repeated here. They are explained on the statewide hit and run page, with the statute text linked.

Two things pay when the other driver is gone, and neither one needs that driver identified. PIP pays regardless of who caused the crash — the 14-day rule applies the same as always. Above PIP, the claim is against your own uninsured motorist coverage.

Here is the part that is usually written wrong. Section 627.727 never mentions hit-and-run or unidentified vehicles. It requires UM coverage unless there is a written rejection on a form approved by the office, and it extends "uninsured motor vehicle" to an insolvent insurer, limits below your damages, and a policy excluding a nonfamily driver. Whether a driver who fled is covered comes from your policy’s own definition, which makes the policy the document that answers it.

And the deadline is not the one people assume. A negligence claim against the driver, if identified, is two years. A UM claim is an action on your insurance policy — a contract founded on a written instrument — which § 95.11(2)(b) gives five years. That is not a reason to wait.

What follows is the part that is specific to Miami-Dade County — where these claims arise, where you will be treated, which courthouse the case goes to, and how the records are obtained.

02 Where the coverage comes from

Where hit and run claims arise in Miami-Dade County

South Dade is the easiest place in the county to leave a crash and not be found. Long unlit two-lane roads, almost no cameras, few witnesses who live nearby, and a highway to the Keys and a Turnpike entrance within minutes of almost anywhere. Which is exactly why the first document to find is the policy, not the police report.

  • Your own uninsured motorist coverageThe main source of recovery above PIP. Check the declarations page for the limits and whether coverage stacks across vehicles.
  • Personal Injury ProtectionPays without regard to fault. The fourteen-day treatment deadline in § 627.736 applies the same as in any other crash.
  • A resident relative’s policyUM coverage frequently extends to a resident relative, which means more than one household policy may be available.
  • The written rejection, if there was oneUM is required unless rejected in writing on a form approved by the office, and the rejection carries forward onto renewals at the same limits.
  • The driver, if identified laterThe negligence claim against them revives, and the UM claim becomes an underinsured one to the extent their limits fall short.
  • US-1 and the Turnpike entranceWhy these crashes stay unsolved here. A vehicle can be on the Turnpike or heading to the Keys within minutes.
  • Krome Avenue and Card Sound RoadUnlit two-lane roads with no cameras and almost nobody living alongside them.
  • Any camera that does existA business on US-1, a packing house gate, a doorbell camera. Few, and all of them overwrite within days.

03 The policy, not the report

What actually answers the question

Most people in this situation wait for the police to find the car, because that feels like the thing the case depends on. It usually is not. The recovery comes from coverage that does not require the other driver to be identified at all.

And the statute is not where the answer is. Section 627.727 never mentions hit-and-run or unidentified vehicles. What it does is require uninsured motorist coverage on every bodily injury policy unless a named insured rejected it in writing on a form approved by the office, and extend the definition of an uninsured motor vehicle to an insolvent insurer, to limits below your damages, and to a policy that excludes a nonfamily driver.

Whether a driver who fled is covered comes from your own policy’s definition of an uninsured motor vehicle. Which makes the policy — not the statute and not the crash report — the document that decides the case. It is a document the insurer will send on request, and reading it is the first useful thing that happens.

There is often more coverage than one policy. UM frequently extends to a resident relative, so a household with two policies may have two sources, and whether coverage stacks across the vehicles on a policy changes the limit substantially.

04 Why it happens here

The geography that keeps these unsolved

South Dade has the conditions a fleeing driver needs, and it has them everywhere. Long two-lane roads with no lighting. Krome Avenue and Card Sound Road with almost nobody living alongside them. Field entrances and farm roads that go somewhere without passing a camera.

And it has two exits. The Homestead Extension of the Turnpike, and US-1 running south to the Keys. From most of this area a vehicle can be on one of them in minutes and out of the county before a report has been taken.

The camera coverage is thin and it is perishable. There are cameras on the US-1 retail strip, at packing house gates and on residential doorbells, and almost all of them overwrite within days. Identifying which ones existed and asking for the footage in writing, early, is the only version of this that works.

None of which changes the claim. It changes the odds that the driver is found, and the point of the UM analysis is that the recovery does not depend on it.

05 The PIP deadline still runs

Fourteen days, whoever caused it

The most common and most costly mistake in a hit-and-run is waiting. People wait for the police investigation, or for the insurer to decide something, and the fourteen-day PIP window closes while they do.

Personal Injury Protection does not care who caused the crash. It pays up to $10,000, covering 80 percent of medical expenses, and under § 627.736 it pays nothing at all unless initial treatment began within fourteen days.

It also has nothing to do with whether the other driver was found. Which means the first week in a hit-and-run looks identical to the first week in an ordinary crash: get treated, get the record created, and get the agency and report number written down.

And report it immediately. Section 316.065(1) requires immediate notice to law enforcement for a crash involving injury or at least $2,000 in property damage, and your own policy will require prompt notice of a UM claim as a condition of it. A late report is the first thing an insurer points at.

06 The evidence that does exist

What to collect when there is no other driver

Write down everything that was seen, immediately, before it is smoothed over by memory. The color, the body style, any part of the plate, a bumper sticker, a dent, which direction it went. A partial plate and a vehicle description is frequently enough for an agency to work with.

Photograph the paint transfer and the damage before anything is repaired. Paint on your vehicle identifies a make and a color, and the height and angle of the damage says something about what hit it. Repairing the car first destroys the only physical evidence in the case.

Ask for footage in writing, and within days. The businesses on US-1 and Campbell Drive, packing house and nursery gates, and residences with doorbell cameras. A verbal request to a manager does not preserve anything, and the retention is short.

Get the names at the scene. This matters more here than in a dense part of the county, because a witness on US-1 may be from out of the area and genuinely unreachable a week later. One phone number taken at the roadside can be the whole identification.

07 Your own insurer

A UM claim is a claim against your own company

This surprises people and it should be said plainly: an uninsured motorist claim is a claim against your own insurance company, under your own contract. It is handled by adjusters whose job is to value it, and that is the structure rather than a betrayal.

Which means the ordinary dynamics apply. There is a demand, a response, a disagreement about value, and a process for resolving it. Your insurer is not acting improperly by disputing the amount; it is doing what the contract sets it up to do.

The policy sets the practical calendar, not the statute. Section 95.11(2)(b) gives five years for an action on a written instrument, but the policy itself will require prompt notice, cooperation, and sometimes an examination under oath. Missing a contractual condition can cost the claim long before any statute runs.

And it is the reason these claims frequently need somebody on the other side of the table. Not because the insurer is behaving badly, but because a claim valued by the company that has to pay it is a negotiation, and a negotiation is easier with the policy, the records and the law in front of you.

08 Examples of situations

Situations this office sees in Miami-Dade County

The following are examples of the kinds of situations that arise in this county. They are illustrations of how the rules apply, not descriptions of past cases, and they do not predict any outcome. Every claim turns on its own facts, its own coverage and its own medical record.

  • The Turnpike entrance

A sideswipe on Campbell Drive and the other vehicle takes the Turnpike ramp. It is out of the county in twenty minutes. The claim still proceeds — on PIP and on uninsured motorist coverage — and the paint transfer on your bumper is the physical evidence.

  • Dusk on Krome

An unlit two-lane with no cameras and nobody living alongside. There is no footage to request and no witness to find. This is precisely the situation uninsured motorist coverage was written for.

  • The parking lot on US-1

A vehicle backs into yours and leaves. Property damage under $2,000 and nobody hurt, so reporting duties are different — but the plaza may have cameras, and they overwrite within days.

  • The plate somebody caught

A bystander photographed three characters of the plate. Combined with the make and color that is frequently enough, and it is the kind of detail that is lost if nobody writes it down in the first hour.

09 The evidence

Evidence that exists here and often goes uncollected

Almost every camera that saw the crash overwrites itself within days or weeks. The difference between a disputed liability case and a straightforward one is usually whether someone asked for the footage while it still existed.

  • Everything seen, written down now

The color, body style, any part of the plate, a dent or sticker, and which direction it went. Memory smooths this over within a day.

  • Paint transfer and damage, unrepaired

Photographed before any repair. Paint identifies a make and color, and the height and angle of the damage says what struck it.

  • A written footage request

To businesses on the corridor, packing house and nursery gates, and nearby residences. Within days, in writing, because retention here is short and a verbal ask preserves nothing.

  • The declarations page

Uninsured motorist limits, and whether coverage stacks. This is the ceiling of the claim, and it is one page.

  • The full policy, not just the summary

The definition of an uninsured motor vehicle is in the policy rather than the statute, and so are the notice conditions a UM claim has to satisfy.

  • The agency and report number

Four agencies work crashes in this area, and the UM carrier will ask for the report. Knowing which one wrote it saves weeks.

10 The report

Reporting it, and getting the report in South Dade

Report it immediately. Section 316.065(1) requires immediate notice to the nearest law enforcement agency for a crash involving injury or at least $2,000 in property damage. In a hit-and-run that report is also what the UM carrier will look for first.

Which agency depends on where it happened. Homestead Police inside the city, Florida City Police in Florida City, the Miami-Dade Sheriff’s Office in the unincorporated areas, and the Florida Highway Patrol on the Turnpike, on Card Sound Road and on the open stretches of US-1.

The report comes through the FLHSMV crash portal, usually within about ten days. Homestead Police Records is at 45 NW 1st Avenue for a report that agency worked. Under § 316.066(2)(a) a report revealing personal information is confidential for 60 days, and § 316.066(2)(b) lets the parties and their legal representatives obtain it immediately.

Leaving the scene is a crime, and the criminal case is separate. Section 316.027 makes it a felony where there was injury, serious bodily injury or death. That prosecution is not your claim and does not have to conclude before the insurance claim proceeds.

Homestead hit and run questions, answered

Do I need a lawyer for a hit and run in Homestead?

Where nobody was hurt and the damage is a repair bill, your own collision coverage usually handles it and that is the sensible route.

Where there is an injury, the claim becomes a claim against your own insurer under your own contract, valued by adjusters who work for the company paying it. That is the situation where having the policy, the records and the statute read properly changes the number.

They never found the driver. Is my claim over?

No. That is the specific situation uninsured motorist coverage exists for, and it does not require the other driver to be identified.

PIP also pays regardless of fault, so the medical layer is available from the beginning as long as treatment began within fourteen days.

Does the statute say hit and run is covered?

It does not use the phrase at all. Section 627.727 requires UM coverage unless it was rejected in writing on an approved form, and it extends "uninsured motor vehicle" to an insolvent insurer, to limits below your damages, and to a policy excluding a nonfamily driver.

Whether a driver who fled is covered comes from your own policy’s definition. That is why the first document to get is the policy rather than the crash report.

Why does this happen so much in South Dade?

Long unlit two-lane roads, very few cameras, and few people living close enough to have seen anything. Krome Avenue and Card Sound Road are the clearest examples.

And two fast exits — the Homestead Extension of the Turnpike, and US-1 running south to the Keys. A vehicle can be out of the county before a report has been taken.

My own insurer is being difficult. Can they do that?

A UM claim is a claim against your own company under your own contract, handled by adjusters whose job is to value it. It is the structure rather than a betrayal.

It is also why these claims are frequently the ones that need somebody on the other side of the table.

What does it cost to ask?

The consultation is free and the representation is on a contingency fee, generally payable only on recovery. Case expenses are governed by the written agreement.

Bring the declarations page. It is usually enough for a first answer.
